It is my understanding that the responsible parties for the site may be 1 ' eligible for reimbursement of eligible clean-up costs-pursuant to Chapter 6.75 of the Health and 2 Safety Code (section 25299.10 et seq.). 3 4) Before remediation alternatives can be evaluated, more data must be generated that will help 4 determine the vertical and lateral extent of the underground contamination. Potential remedial 5 ; alternatives may include soil vapor extraction, pumping of groundwater and treatment of the 6 same (pump and treat), natural attenuation, or a combination of some of these activities. 7 5) Once the responsible party generates (through. its consultant) sufficient data to define the 8 lateral and vertical extent of the contamination, he will then be required to prepare a number of 9 submittals including but not limited to a risk assessment, an estimate of the mass of 10 contamination, a fate and transportmodel and a Remedial Action Plan ("RAP"). All of these 11 submittals will be reviewed by my office and commented upon until there is an approved RAP. 12 Even with an approved RAP, once the work commences additions and/or alterations in the 13 required work maybe required. 14 6) Once there is an approved RAP, the responsible party will thereafter be required to 15 implement the work, monitor and report the work results until this office determines that the 16 system can be discontinued. That determination is typically based on whether continued 17 operation of the-system-will be effective, EHD does not know how long it will take to complete 18 the investigation and remediation of the site. 19 I declare under penalty of perjury of the laws of the State of California that the foregoing 20 is true and correct.
