Spill Prevention, Control and Countermeasure Plan <br /> Tesla Treatment Facility Page 4 of 45 <br /> 1.4.6 Extension of Time for Plan Provisions [40 CFR§112.3(f)] <br /> The Tesla Treatment Facility has not requested from the Regional Administrator for an extension <br /> of time to fully prepare, amend as-needed, and implement the SPCC Plan. The SPCC Rule <br /> requirement for maintaining and implementing the SPCC Plan, and amending the plan as-needed, <br /> remains in effect. <br /> 1.4.7 Qualified Facilities [40 CFR§112.3(g)] <br /> 40 CFR§112.3(g) of the SPCC Rule is not applicable because the aggregate aboveground oil <br /> storage capacity at the Tesla Treatment Facility exceeds 10,000 gallons. <br /> 1.5 SPCC Plan Amendments [40 CFR§112.41 <br /> Section 40 CFR§112.4 describes general conditions or events that require an amendment of the <br /> SPCC Plan by the owner or operator of any facility that is subject to the SPCC Rule. <br /> 1.5.1 Discharge Reporting Requirement [40 CFR§112.4(a)] <br /> As per 40 CFR§112.4(a)of the SPCC Rule,whenever a facility discharges more than 1,000 gallons <br /> of oil in a single discharge event, or discharges more than 42 gallons of oil in each of two (2) <br /> discharges within a 12-month period, the facility must report the following information to the <br /> Regional Administrator, SJCEHD, within 60 days from the time of discovery of the discharge: <br /> ® Name of facility. <br /> Name of individual filing the report. <br /> Location of facility. <br /> Maximum storage or handling capacity of the facility and normal daily throughput. <br /> ® Corrective action and countermeasures taken, including any equipment repairs and <br /> replacements. <br /> An adequate description of the facility. <br /> © The cause for such discharge, including a failure analysis of the system that failed. <br /> ® Additional preventive measures taken or planned to minimize the possibility of <br /> discharge recurrence. <br /> ® Any other information as the Regional Administrator may reasonably require that is <br /> pertinent to the SPCC Plan or discharge event. <br /> 1.5.2 Applicability of Reporting Requirement [40 CFR§112.4(b)] <br /> Section 40 CFR§112.4 of the SPCC Rule applies because this SPCC Plan represents an amendment <br /> and update to the initial SPCC Plan for the Tesla Treatment Facility. <br />
