2 3 5 6 7 8 9 10 11 12 13 14 15 16 110 18 19 20 21 22 FM 28 WHEREAS, Plaintiff, the People of the State of California ("People") and defendant Target Corporation ("Target"), by their respective attorneys, entered into a Stipulation for Entry of Final Judgment and Permanent Injunction dated January 27, 2011 and thereby have consented to the I entry of this Final Judgment and Permanent Injunction on Consent ("Final Judgment on I Consent"); AND WHEREAS, the Court finds that the settlement between the People and Target is fair I and in the public interest; NOW THEREFORE, upon the consent of the aforementioned parties, it is hereby FINAL JUDGMENT AND PERMANENT INJUNCTION ON CONSENT 1. JURISDICTION The parties stipulate and agree that the Superior Court of California, County of Alameda I has subject matter jurisdiction over the matters alleged in this action and personal jurisdiction over the parties to this Final Judgment on Consent. 2. SETTLEMENT OF DISPUTED CLAIMS This Final Judgment on Consent is not an admission by Target regarding any issue of law or fact in the above -captioned matter or any violation of law. The People and Target enter into this Final Judgment on Consent pursuant to a compromise and settlement of disputed claims for purposes of furthering the public interest. The People believe that the resolution embodied in this Final Judgment is fair and reasonable and fulfills the People's enforcement objectives; that except as provided in this Final Judgment on Consent, no ftirther action is warranted concerning the allegations contained in the First Amended Complaint ("FAC"), attached hereto as Exhibit A; and that entry of this Final Judgment on Consent is in the best interest of the public. Target agrees that this Final Judgment on Consent is a fair and reasonable resolution of the matters alleged in the First Amended Complaint. The parties also waive their right to appeal.
