DEFINITIONS <br />Except where otherwise expressly defined in this Final Judgment on Consent, all terms <br />shall be interpreted consistent with Chapters 6.5 and 6.95 of Division 20 of the California Health <br />and Safety Code and the regulations promulgated under these chapters. <br />"California Facilities" means the Target retail stores, distribution centers, and other Target - <br />I owned facilities in the State of California listed in the attached Exhibit B. <br />"Certified Unified Program Agency" or "CUPA" is an agency certified by the California <br />I Environmental Protection Agency pursuant to the requirements of Chapter 6.11 of the California <br />Health and Safety Code, and Title 27 of the California Code of Regulations, to implement certain <br />State environmental programs within the local agency's jurisdiction. <br />"Participating Agency" means an agency that has been designated by the CUPA to <br />administer one or more state environmental programs on behalf of the CUPA. <br />"Target Facilities" means the California Facilities and any additional Target retail store-, <br />distribution center, or other facility that Target opens in the State of California. <br />4. PAYMENTS FOR CIVIL PENALTIES, SUPPLEMENTAL <br />ENVIRONMENTAL PROJECTS AND COSTS <br />Target shall, within ten days of entry of this Final Judgment on Consent, pay civil penalties, <br />fund the supplemental environmental projects provided for in this Final Judgment on Consent and <br />pay costs in the total amount of twenty-two million, five hundred thousand dollars <br />($22,500,000.00). Said payment shall be made as set forth in paragraphs 4..1 through 4.5 below. <br />On entry of this Final Judgment on Consent, Target shall deliver all required payments to the <br />Attorney General for the State of California, for distribution pursuant to the terms of this Final <br />Judgment on Consent. <br />4.1. Civil Penalties <br />Target shall pay seventeen million dollars ($17,000,000.00) as civil penalties pursuant to <br />sections of the California Health and Safety Code and the California Business and Professions <br />Code, to the prosecuting agencies/regulatory agencies identified in, and in accordance with the <br />terms of, Exhibit C, attached. <br />on <br />3 <br />v.
