Supplemental Environmental Proiects <br />Target shall pay for Supplemental Environmental Projects with a total value of two million, <br />I five hundred thousand dollars ($2,500,000.00) to the entities identified and in accordance with the <br />I terms of Exhibit D, attached. <br />4.3. Reimbursement of Costs of Investigation and Enforcement <br />Target shall pay three million dollars ($3,000,000,00) for reimbursement of attorney's fees, <br />costs of investigation, and other costs of enforcement to the entities identified in and in <br />accordance with the terms of Exhibit C, attached. <br />4.4. Copy of Payments to Plaintiff's Representatives <br />Target shall send an electronic confirmation of any payment made by wire transfer to each <br />of the People's representatives identified in paragraph 8 at the time of payment. <br />4.5. Late Payments <br />Target shall be liable for a civil penalty of Twenty -Five Thousand Dollars ($25,000.00) for <br />I each calendar day that any payment required pursuant to paragraphs 4.1 , through 4.3 is late. <br />5. INJUNCTIVE RELIEF <br />Pursuant to the provisions of California Health and Safety Code sections 25181 and 25516 <br />and California Business and Professions Code section 1720.3, Target is permanently enjoined to <br />comply with Chapters 6.5 and 6.95 of Division 20 of the California Health and Safety Code, and <br />the regulations promulgated under these chapters, and to comply with California Health and <br />Safety Code section 117600 et. seq. at the Target Facilities. Failure to comply with this Final <br />Judgment on Consent and the specific additional injunctive provisions that follow may subject <br />Target to sanctions, including but not limited to contempt and additional penalties in this action as , <br />well as any separate enforcement action that may be brought. <br />5.1. Specific Iniunctive Provisions: <br />5.1. a. Target shall not dispose, or cause the disposal of, any hazardous waste at <br />a point not authorized or permitted by the Department of Toxic Substances Control, in violation <br />of Health and Safety Code section 25189, including, without limitation, to trash compactors, <br />dumpsters, drains, sinks, or toilets at a Target Facility, onto the surface or subsurface of the <br />4 <br />(Proposed] Final Judgment and Permanent Iniunction on Consent in People v.
