Defendant, with actual or constructive knowledge of this Injunction, only in so far as they <br />are doing business in the State of California, in the course of Defendant's MARINA AND BOAT <br />STORAGE activities, are pursuant to Health and Safety Code section 25181 hereby permanently <br />I enjoined from: <br />a. Failing to maintain and operate facility to minimize the possibility of a fire, <br />explosion, or any unplanned sudden or non -sudden release of hazardous waste, in violation of <br />California Code of Regulations, title 22 section 66265.31; <br />b. Failing to maintain all communication or alann systems, spill control, or <br />decontamination equipment, in violation of California Code of Regulations, title 22 section <br />166265.33; <br />c. Storing hazardous waste on site greater than 180 days, in violation of California <br />Code of Regulations, title 22 section 66262.34(d); and <br />d. Failing to retain for at least three years, a copy of manifest or bill of lading which <br />identities shipping of spent lead -acid storage batteries, in violation of California Code of <br />Regulations, title 22 section 66266.8 1 (a)(4)(B). <br />4. Defendant, with actual or constructive knowledge of this Injunction, only in so far as they <br />are doing business in the State of California, in the course of Defendant's MARINA AND BOAT <br />STORAGE activities, are pursuant to Health and Safety Code section 25299.01 are permanently <br />enjoined from: <br />a. Failing to maintain written monitoring and maintenance records on-site, in <br />\,iolation of California Code of Regulations, title 23 section 2712(b); <br />b. Failing to maintain secondary contaimnent system which prevented any releases <br />from flowing to a collection sump located at the low point of underground piping, in violation of <br />California Code of Regulations, title 23 section 2636(c)(1); <br />c. Failing to maintain a copy of the monthly inspection record and all attachments for <br />the previous twelve (12) months, in violation of California Code of Regulations, title 23 section <br />-2- <br />PERM IAMENT INJUNCTION <br />
