Failing to perforin periodic testing of secondary containment system, in violation <br />of California Code of Regulations, title 23 section 2637(a); and <br />e. Failing to provide training by a designated underground storage tank operator for <br />facility employees on the proper operation and maintenance of the underground storage tank system <br />once every twelve (12) months , in violation of California Code of Regulations, title 23 section <br />2715(f). <br />5. Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br />are doing business in the State of California, in the course of Defendant's MARINA AND BOAT <br />STORAGE activities, are, pursuant to California Business and Professions Code section 17204, <br />hereby permanently enjoined from: <br />a. Violating Health and Safety Code section 25100 et seq., as described in paragraph <br />3 — 3(d) above; and <br />b. Violating Health and Safety Code section 25280 et seq., as described in paragraph <br />14 - 4(e) above. <br />6. Defendants shall pay to Plaintiff the sum of SEVEN THOUSAND SEVEN HUNDRED <br />SIXTY-TIIREE DOLLARS AND SEVENTY-FIVE CENTS ($7,763.75), as and for civil penalties, <br />pursuant to Health and Safety Code §25299. Said payment shall be made payable to the SAN <br />JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT - ENVIRONMENTAL <br />HEALTH DIVISION TRUST. Said payments shall be delivered to the San Joaquin County Office <br />of the District Attorney, Environmental Prosecutions Unit, on or before September 15, 2014. <br />7. Defendants shall pay to Plaintiff the sum of SEVEN THOUSAND SEVEN HUNDRED <br />SIXTY-THREE DOLLARS AND SEVENTY-FIVE CENTS ($7,763.75), as and for civil penalties, <br />pursuant to Business and Professions Code section 17206. Said payments shall be made payable to <br />the TREASURER OF SAN JOAQUIN COUNTY and delivered to the San Joaquin County Office of <br />the District Attorney, Environmental Prosecutions Unit, on or before September 15, 2015. <br />8. Defendant shall be penalized, as and for civil penalties, pursuant to Business and <br />Professions Code sections 17200 et seq., in addition to those civil penalties set forth in paragraphs 6 <br />-3— <br />PERNIAMENT INJUNCTION <br />
