Weber Ave, Stockton CA <br />Health & Safety Code (HSC) 25295 (a)(1) Unauthorized Release; <br />Any unauthorized release which escapes from the secondary containment, or from the primary <br />containment, if no secondary containment exists, increases the hazard of fire or explosion, or causes <br />any deterioration of the secondary containment of the underground tank system shall be reported by the <br />owner or operator to the local agency designated pursuant to Section 25283 within 24 hours after the <br />release has been detected or should have been detected. A full written report shall be transmitted by the <br />owner or operator of the underground storage tank system to the local agency within five working days <br />of the occurrence of the release. The report shall describe the nature and volume of the unauthorized <br />release, any corrective or remedial actions undertaken, and any further corrective or remedial actions, <br />including investigative actions, which will be needed to clean up the unauthorized release and abate the <br />effects of the release and a time schedule for implementing actions. <br />➢ On September 3, 2005, this facility had a piping failure under the dock, which resulted in <br />gasoline being released into the Delta and no report was made within 24 hours. <br />2004 Compliance Violations <br />Health & Safety Code 25292.2(a) All owners and operators of an underground tank system shall <br />maintain evidence of financial responsibility for taking corrective action and for compensating third <br />parties for bodily injury and property damage caused by a release from the underground tank system, in <br />accordance with regulations adopted by the board pursuant to Section 25299.3. The regulations shall <br />include a schedule that requires that financial responsibility requirements are phased -in for all <br />underground storage tank systems on or before October 26, 1990. <br />➢ At the time of inspection this facility had not submitted their financial responsibility. EHD <br />inspections performed in February 2001, October 2001, May 2003, and June 2004 requested <br />the financial information to be submitted. <br />➢ RHD received the required -fin zcial information on .tune 10, 2004, <br />California Code of Regulations (CCR) Section 2636 (c)(1) Primary piping in contact with hazardous <br />substances under normal operating conditions shall be installed inside secondary containment system <br />which may be a secondary pipe, vault, or a lined trench.
