El Dorado Street, Stockton, CA Dear Ms. Heran: In my July 31 and August 4, 2000 facsimile correspondences (copies attached), I attempted to bring to your attention a problem our clients, including Mr. and Ms. Stephen Valentine, are experiencing in dealing with your:LOP program staff. On July 31, 2000 we discussed the problem in our telephone conversation and you subsequently informed me that you were addressing the issue by seeking a legal opinion from County Counsel's office. We appreciate your attention to this matter and are awaiting the County's response. In an August 14,2000 letter(copy attached),your office states that: "The domestic well located at 60 Castle Street has been impacted by gasoline contaminants_ This well is no longer being used (considered abandoned) and must be destroyed under permit and inspection of PHSIEHD pursuant to San Joaquin County Well Standards, Section 1. Since the well has been impacted with gasoline contamination from your site, you are responsible for the proper destruction of the well." Could you please provide to GTI and our clients a copy of the law/statute/regulation that requires the Valentines to assume responsibility for an abandoned well (as your staff noted) on adjacent private property? Furthermore, on page 2 of the County letter, it states: "If the well is not destroyed by November 1, 2000, PHS/EHD will issue an official Notice to Abate to the owner of the property where the domestic well is located, requiring the well
