Any legal remedies sought by the property owner where the domestic well
is located due to this action by PHS/EHD will be your responsibility."
In my August 4, 2000 fax, I asked you the question—to whom would the Notice to Abate
(a legal County action) be sent, the property owner at 60 Caste or the Valentines? The
above statement answers my question with an added threat to effect that the adjacent
property owner will seek a legal remedy if the County forced them to destroy their illegally
abandoned well. Again, we ask, could you please provide a copy of the
law/statute/regulation that requires the Valentines to accept responsibility for legal
remedies due to a County enforcement action under the Well Standards, for a well they do
not own and on property they do not own?
In conclusion, please note that the County letter refers to deadlines for the completion of
activities for which you are seeking a legal opinion from the County Counsel's Office.
Could you please call GTI as soon as possible and tell us if the submittal of the work plan
(due August 25, 2000), and domestic well destruction plan (due October 15, 2000) are
lawful directives to our clients from PHS/EHD? I ask this because we are under the
opinion that the work suggested by Mr. Wong was a "recommendation" and not a
directive.
Please call me at 209-538-6424.
Respectfully Submitted,
Ceolo cal7ecitzits Inc.
Joseph D.
