Box 1219 <br /> Lathrop, CA 95330 <br /> REQUEST FOR A REPORT OF WASTE DISCHARGE, CALIFORNL4 NATURAL PRODUCTS, <br /> LATHROP,SAN JOAQUIN COUNTY <br /> I have reviewed your 3 December 2004 correspondence that notifies the Regional Board of California <br /> Natural Products' plan to change the land application area configuration. The proposed change will add <br /> 7.5-acres to the 10.1-acre land application area and remove 5.5-acres from the 9.2-acre landscape <br /> application area. The changes will result in a net increase of land application area of approximately <br /> 2-acres. The proposed change requires submittal of a Report of Waste Discharge (RWD). California <br /> Water Code Section 13260(c)requires: <br /> Every person subject to subdivision (a) shall file with the appropriate regional board a report <br /> of waste discharge relative to any material change or proposed change in the character, <br /> location, or volume of the discharge. <br /> Submittal of an RWD is required prior to changing the wastewater application areas. You may submit it <br /> at your convenience but please allow at least 150 days for staff to process the application. Because <br /> California Natural Products' WDRs were updated relatively recently (5 September 2003), an abbreviated <br /> RWD will likely be acceptable. <br /> An RWD consists of the Form 200 ApplicationlReport of Waste Discharge General Information <br /> (enclosed), a filing fee (already paid through the annual fee program), and the answers to the Additional <br /> Questions. A California Registered Engineer shall prepare the technical report. The RWD, at a <br /> minimum, shall address the Additional Questions; it shall also include any additional information <br /> required to explain the site-specific processes. Background groundwater quality at the 10.1-acre land <br /> application area has not been adequately defined; therefore, a groundwater investigation shall be <br /> performed to define background groundwater quality at the 10.1-acre land application area. Definition <br /> of background groundwater quality has been an issue at the land application area since WDRs Order No. <br /> R5-2003-0141 was adopted. Submittals intended to address the issue have been incomplete and have <br /> not adequately addressed the issue. A 15 July 2004 Hydrogeologic Evaluation Review correspondence <br /> prepared by the Regional Board raised a number of issues that remain. The issues are: <br /> • Staff does not agree with the report's conclusion that Well W-5 is an appropriate upgradient well <br /> for the 10.1-acre land application area. Well W-5 is located downgradient of the 10.1-acre land <br /> application area in Kleinfelder's groundwater elevation contour maps. <br /> California Environmental Protection Agency <br /> 0 Recycled Paper <br />
