AGE and Mr_ Panetta were unable <br />to locate any records on file with the City of Tracy Fire Department or- San Joaquin County <br />Environmental Health Department (SJCEHD) regarding UST other than the one discovered <br />and removed in 2003. <br />• Attached is an appropriately labeled map with the location of the known UST and the <br />assumed locations of other undocumented USTs. <br />• Attached is documentation indicating that Mr. Panetta does not employ more than 500 full <br />time employees. <br />• Attached is a completed Certification of Financial Responsibility. <br />• Attached is a copy of Mr. Panetta's purchase agreement from Harley -Murray Trust, the <br />previous owner. <br />• Since the claimant acquired the site as a vacant lot with no known USTs his compliance with <br />Fund Regulations Section 2811 (a)(l)-(2) and Health and Safety Code, Section 25299.54, <br />subdivision (h) is not applicable. <br />• Since the claimant acquired the site as a vacant lot with no known USTs there is no permit <br />to own or operate the UST from a local implementing agency. The UST discovered in <br />October 2003 was removed on 05 November 2003 under permit from the SJCEHD. <br />• Since the claimant acquired the site as a vacant lot with no known USTs his compliance with <br />the 22 December 1998 deadline to have all single walled USTs upgraded or removed is not <br />applicable. <br />• Since the claimant acquired the site as a vacant lot with no known USTs the claimant does <br />not have a permit to own or operate a UST. <br />• There were no active USTs on the site at the time of acquisition by Mr. Panetta; therefore, <br />no Underground Storage Tank Upgrade Certificate is possible. <br />• Attached to this letter is a copy of the claimant's removal permit for the 500 gallon UST and <br />the local regulators report. <br />• The release discovered in May 2000 was never resolved or defined. The release discovered <br />in October 2003 was considered a "new" occurrence. However, the releases were <br />"discovered" in the same area, therefore making the two indistinguishable. A review of site <br />data indicates that contamination more likely emanates from the known UST and appurtenant <br />system (dispenser islands), rather than the assumed (taut not documented) locations of other <br />USTs at the site. <br />Since the claimant acquired the site as a vacant lot with no known USTs and since the <br />Advanced GeoEnvironmentai, Inc. <br />
