'yyR <br />Joe Panetta — JNL Farms page 2 <br />95 W. 11th St., Tracy. <br />In order to effectually return this site to active ground water monitoring and continue the <br />required investigation, EHD hereby directs you to: <br />• Repair or destroy and replace MW -5 immediately. <br />• Submit by May 14, 2004, a site map showing the proposed locations for the <br />required monitoring wells and propose an adequate number of wells for <br />installation to identify the lateral and vertical limits of the petroleum impact. <br />• Install the monitoring wells within 30 -days of EHD approving the locations. <br />• Collect soil samples during drilling activities for the monitoring well <br />installations and have the samples analyzed for TPHg, BTEX, seven <br />Oxygenates, 1,2 -DCA, and EDB by EPA Method 82606. <br />• Start quarterly monitoring and reporting of all ground water sample results <br />from all the monitoring wells. The ground water samples should be <br />analyzed for the same contaminants listed above for the soil samples. <br />• Submit a report of findings on the monitoring well installations within 60 - <br />days of their completion. <br />Well permit applications for the additional monitoring well installations should be <br />submitted immediately. A City of Tracy encroachment permit is required for monitoring <br />wells placed in the city right of way. Wells proposed to be installed offsite on parcels <br />NOT under your ownership will require access agreements to be submitted to EHD prior <br />to issuance of a well permit. Please take immediate steps to secure any <br />offsite/encroachment permits now so meeting your deadlines will not be a problem. <br />Failure to comply with directives issued by EHD could jeopardize your ability to become <br />or remain eligible to receive reimbursement from the State Water Resources Control <br />Board (SWRCB) Clean Up Fund (CUF) and could also result in a referral to the San <br />Joaquin County District Attorney's office for enforcement action. <br />You must take immediate action to provide an active and adequate investigation.
