Page two of your claim application identities site as Former Tracy <br />Diner, 95 West 11th Street in Tracy. Below are two sites listed on Geo Tracker. Are these the same <br />site? <br />Former Restaurant @ 95 11`h St W., Tracy <br />Panetta Property @ 95 IE. 11th Street <br />• Page one (1) of your claim application was incomplete. Please complete the section for Tax <br />Identification No. Claimant's tax identification number must correspond with the claimant name <br />(e.g. individual -social security number; corporation, partnership, estate, trust -federal tax identification <br />number). <br />• Page two (2) of your claim application doesn't reflect information you submitted. Please revise or <br />explain. Page 2 lists: <br />1. Date of Release Discovered 05/10/00 (prior to claimant's' acquisition of site). The first <br />UST Unauthorized Release (LEAK) / Contamination Site Report (dated 05/10100) <br />identifies the Responsible Party as JLtii Farms Inc. et.ai. It appears that there was another <br />release discovered. The second LEAK Report (dated 10121103) identifies Joe Panetta as <br />the Responsible Party. Was the first release ever resolved by the previous <br />owner/operator? Was that release from different USTs and were they removed prior to <br />your acquisition of site? Is there any affiliation between claimant and JLN Farms Inc. <br />et.al? <br />2. Date Regulatory Agency Confirmed Release and Issued Cleanup Directives as 06128100. <br />The San Joaquin County letter dated 06/29/00 appears to be a directive to Joe <br />Nomellini/JLN Farms Inc., not claimant. The San Joaquin County letter dated 11/17/03 <br />appears to be the first directive to claimant.
