I It' Street APN: 233-130-24 <br />Tracy, CA. 95376 <br />San Joaquin County Environmental Health Department (EHD) has reviewed <br />Interim Sort Remediation Work Plan dated November 3, 2003 as submitted by <br />Advanced GeoEnvironmental on November 5, 2003 and has the following <br />comments. <br />With the discovery of an abandoned underground storage tank (UST) on October <br />31, 2003, you may be eligible for reimbursement of costs from the State Water <br />Resources Control Board (SWRCB) for investigative and remedial work required <br />and approved by EHD. <br />The SWRCB Clean Up Fund (CUF) and UST Regulations require work plans to <br />be approved by EHD prior to enactment. In addition, the CUF requires <br />responsible parties to be in compliance with directives issued by EHD, conduct <br />investigations that are cost-effective and feasible in order to qualify for, and <br />receive reimbursement for work done at the site. <br />Previously, the CUF required responsible parties to obtain `pre -approval' for <br />costs included in a work plan EHD has approved. In correspondence dated <br />November 3, 2003 the SWRCB-CUF stated that due to staffing shortages, it was <br />suspending the processing of cost preapprovals. Since remediation costs are. <br />not being preapproved, please be aware that -costs may not be reimbursed if it <br />cannot be shown that the most cost-effective remediation was performed. <br />The CUF cost guidelines should be used to evaluate alternatives for cost <br />effectiveness. The work plan submitted is a continuation of work done on the site <br />in preparation for the construction of an office building. That work was performed <br />prior to you being eligible to apply to the CUF for reimbursement of costs. <br />
