(AGE) has prepared this letter to <br />inform the San Joaquin County Environmental Health Department (EHD) no field work was <br />conducted at 95 West 11th Street, Tracy, California (site) during the first quarter 2009. A quarterly <br />ground water monitoring event was not performed at the site due to the current status the State of <br />California Underground Storage Tank Cleanup Fund (USTCF), which funds the site's environmental <br />cleanup. <br />As the EHD maybe aware, the USTCF has notified all claimants payment ofreimbursement requests <br />are delayed beyond "historical time periods". A reimbursement request for Mr. Panetta for over <br />$45,000 was submitted to the USTCF in December 2008. It is unlikely Mr. Panetta will receive any <br />reimbursement monies for up to 18 months after the reimbursement request submittal date. <br />Mr. Panetta does not have the financial capabilities to continue quarterly ground water monitoring <br />activities at the site until he can receive reimbursement from the USTCF. Therefore, on behalf of <br />Mr. Panetta, AGE is requesting a suspension of quarterly ground water monitoring (wells MW -5 <br />through MW -14) activities at the site pending site closure. <br />As recommended in the AGE -prepared Quarterly Report - Fourth Quarter 2008 dated 20 January <br />2009, AGE would like the EHD to consider this site for closure based on the following: <br />• Low-risk site closure as defined in Section 6.3 of Appendix A of the Tri -Regional <br />Recommendations: 1) The release has been stopped and the source of the contamination has <br />been removed (excavation); 2) The site has been adequately characterized; 3) No waters of <br />the State, or other sensitive receptors are likely to be impacted. <br />837 Shaw Road, Stockton, California 95215 <br />Telephone (209) 467-1006 Fax (209) 467-1118 <br />
