Landscape <br /> improvements to a specific segment shall be completed no later than the time at <br /> which adjacent parcels have been issued building permits. Completion time may be <br /> modified by the MHCSD General Manager to reflect construction, weather, budget, or <br /> other public interest contingencies. <br /> Q. Landscape Edge Treatments at 1-205,west edge embankment of Mountain House <br /> Parkway from Spatafore Parkway to 1-205, and PG & E Right-of-Way shall be <br /> developed and maintained by a separate maintenance entity. These areas shall <br /> require a funding mechanism for maintenance acceptable to MHCSD. All required <br /> utility line easements acceptable to MHCSD shall be dedicated to MHCSD. Timing: <br /> Financing mechanism shall be completed and adopted by the Board of Directors prior <br /> to the approval of the first Final Map. Plans shall be reviewed and approved by <br /> MHCSD prior of approval of the first Building Permit. <br /> R. All landscape and utility R/W areas within Mountain House Business Park that were <br /> not in the original Master Plan, the MHCSD Parks, Recreation and Leisure Plan,the <br /> TIF or the CFF(January, 2003)as determined by MHCSD, will require a funding <br /> mechanism as determined by MHCSD. These areas will require establishment of a <br /> maintenance entity or financing mechanism acceptable to MHCSD to provide funding <br /> for maintenance of, and if necessary, replacement at the end of the useful Irfe of <br /> improvements including, but not limited to landscaping, pathways, walls, and all <br /> improvements serving or for the special benefit of this subdivision. The financing <br /> mechanism shall be completed and adopted by the Board of Directors prior to the <br /> approval of the first Final Map. <br /> 83. Architectural Building Elevations Along 1-205. All architectural building elevations that are <br /> oriented toward the 1-205 freeway, including lot 19 and all buildings on lots immediately <br /> adjacent to the 1-205 freeway right-of-way, shall be designed to provide building fagade relief <br /> and a distinct character to clearly reflect the common architectural theme for the Mountain <br /> House Business Park. The architectural design of buildings shall be consistent with all <br /> Community Approvals including applicable provisions of the Master Plan, Specific Plan I, <br /> MHCSD Design Manual and any applicable Special Purpose Plan. Timing: Plans shall be <br /> reviewed and approved prior to first building permit. <br /> 84. FEES <br /> A. Development within the project shall be subject to the payment of all applicable and <br /> lawfully enacted County and MHCSD fees. <br /> B. All Annexation fees shall be paid pursuant to the MHCSD Annexation Ordinance and <br /> any annexation agreement. <br /> III. COUNTY COUNSEL(Staff Contact: Sheryle Sparks,468-2980) <br /> 1. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, <br /> the subdivider shall defend,indemnify, and hold harmless the local agency or its agents, <br /> officers,and employees from any claim,action, or proceeding against the local agency or its <br /> agents,officers,or employees to attack, set aside, void,or annul an approval of the local <br /> agency, advisory agency, appeal board, or legislative body concerning a subdivision,which <br /> action is brought within the time provided for in Section 66499.37 of the Government Code. <br /> Timing: Priorto recordation of the Final Map. <br /> IV.
