LICENSE TO ENTER REAL PROPERTY <br /> This Agreement("Agreement") is made by and between the Fahn Bros. Properties, LLC <br /> ("Owner"), and Western Geo-Engineers, Inc , a California corporation ("Contractor") <br /> 1. PROPERTY DESCRIPTION, Owner is the owner of that certain real property <br /> (the "Property") depicted on Exhibit "A," attached hereto and incorporated herein by reference <br /> 2 GRANT OF LICENSE. Owner hereby grants to Contractor a license to enter the <br /> Property for the purposes and subject to the limitations set forth below, <br /> a Purpose of Entry. Contractor may enter the Property only for the limited <br /> purposes of destroying wells MW'6 and MW9 in the locations shown on Figure 1, attached <br /> hereto and incorporated herein by reference (hereinafter "Permitted Work") <br /> b Persons Permitted to Enter Entry for the purposes described above shall <br /> be limited to Contractor and its employees, agents, consultants and designated representatives, <br /> (1) IDENTIFICATION OF THE CONTRACTOR'S <br /> REPRESENTATIVE Contractor shall,prior to the commencement of the Permitted Work, <br /> identify to Owner the person who shall act as the representative of Contractor in connection with <br /> the performance of the terms and conditions of the Agreement(the "Responsible Person"), which <br /> person shall have full and complete authority to bind Contractor in connection with all matters <br /> pertaining to the Permitted Work <br /> (2) IDENTIFICATION OF RESPONSIBLE INDIVIDUAL Contractor <br /> shall, prior to the commencement of the Permitted Work, provide to Owner the names of all <br /> Contractor's employees, agents and independent contractors who will perform or supervise the <br /> Permitted Work, including, without limitation all persons authorized to enter upon the Property <br /> during the term of Agreement so that Owner may be in the position to identify and morutor the <br /> activities of persons on the Property. <br /> c.
