1 <br />WHEREAS this facility is in violation of Title 14, California <br />2 <br />Code of Regulations (CCR) , section 18420 (a) - Applicability, which <br />3 <br />requires every operator of a major or minor WTF that stores, <br />4 <br />stockpiles, accumulates or discards waste tires to acquire a <br />5 <br />Permit; and <br />6 <br />WHEREAS this facility is in violation of Title 14, CCR, <br />7 <br />section 17351- Fire Prevention Measures, which requires that WTF <br />8 <br />operators must have communications (if attended), adequate fire <br />9 <br />fighting equipment, and an adequate water supply; and <br />10 <br />WHEREAS this facility is in violation of Title 14, CCR, <br />11 <br />section 17353- Vector Control Measures, which requires that WTF <br />12 <br />operators must prevent the breeding and harborage of mosquitoes, <br />13 <br />rodents, and other vectors; and <br />14 <br />WHEREAS this facility is in violation of Title 14, CCR, <br />15 <br />section 17354- Storage of Waste Tires, which requires that WTF <br />16 <br />operators must store waste tires in accordance with the waste tire <br />17 <br />standards to meet dimension requirements, fire standards, control <br />18 <br />of water runoff, and rim removal; and <br />19 <br />WHEREAS this facility is in violation of Title 14, CCR, <br />20 <br />section 18423- Filing of Application, which requires every <br />21 <br />operator of a major or minor WTF to submit a completed Permit <br />22 <br />application; and <br />23 <br />WHEREAS the CIWMB has the authority to order WTF operators <br />24 <br />who are in violation of the aforementioned regulations, to clean <br />25 <br />up waste tire piles, abate the effects thereof, or otherwise <br />26 <br />remediate a case of threatened pollution or nuisance pursuant to <br />27 <br />PRC, section 42845(a); and <br />2. <br />
