1 <br /> Mr. Vaughn - 2 - <br /> On February 9, 1990, an analysis of the soil and water at your <br /> site showed extreme contamination. <br /> The Regional Water Quality Control Board has requested that <br /> you take the necessary steps to define the limits of that <br /> contamination. <br /> ii <br /> While we are sympathetic to your concern regarding the cost of <br /> this investigation and potential cleanup effort, current law <br /> requires that the steps outlined by Mr. Peltier be implemented by <br /> the party responsible for the contamination or the owner of the <br /> contaminated property. <br /> You have clearly indicated that you feel that another party is <br /> responsible for the contamination, but that you do not want to <br /> burden them, as it would possibly bankrupt them. Your situation is <br /> difficult. On the one hand, you could pursue legal means of <br /> assigning the responsibility for the contamination to the previous <br /> owners, or on the other hand, you could clean up the site yourself. <br /> Both options appear from your letter to be unacceptable or <br /> unaffordable. <br /> Recently, legislation was enacted to provide some financial <br /> support to owners of' active tanks who have county permits to <br /> properly operate the'; underground storage tank. From your <br /> description of your operation, it does not appear that your site <br /> would qualify for such assistance, and there are no other <br /> assistance plans available of which we are aware. <br /> The regulatory agencies responsible for enforcing the cleanup <br /> requirements have stated that complete cleanup is not expected at <br /> this time. However, ' it is necessary to assess the extent of <br /> contamination such that a cleanup plan can be developed for future , <br /> implementation. Perhaps you could contact the previous owners of <br /> the property and make an arrangement to share the financial burden <br /> of site assessment. <br /> I sincerely regret that there is no financial assistance <br /> available at this time and-'that we cannot relieve you or the <br /> previous owners of the financial burdens you face.
