t If <br /> Conditions of Approval for the Special Purpose Plan <br /> Special Purpose Plan No. PP-00-2 was approved by the Board of Supervisors on The <br /> effective date of approval is <br /> Unless otherwise specified,all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Kerry Sullivan,468-3140) <br /> a. CULTURAL RESOURCES: A Native American monitor shall be hired to be on the site during <br /> project ground disturbing activities. In the event of a discovery, the Native American monitor shall <br /> contact the Community Development Department. A qualified archaeologist shall determine the <br /> value of said resources and implement data recovery operations,protection in place, and/or archival <br /> research as required. <br /> 2. PUBLIC HEALTH SERVICES(Staff Contact Raymond Borges,468-3284) <br /> a. Future development shall be provided with public water and public sewer services. <br /> b. The Storm Drainage Master Plan shall be approved by the Central Valley Regional Water Quality <br /> Control Board. <br /> 3. STATE DEPARTMENT OF FISH AND GAME (Staff Contact: Dan Gifford,369-8851) <br /> a. BURROWING OWL: Protocol burrowing owl surveys shall be conducted on the project site. If <br /> there are construction activities proposed during the owl breeding season, and if burrowing owls are <br /> observed at or within 250 feet of the project site during pre-construction surveys, a 250-foot-wide <br /> protective buffer shall be established around the owls. The buffer shall be protected by placement <br /> of a barrier(construction fence)that will remain in place for the duration of the breeding season. If <br /> the burrowing owl habitat would be affected by the project, and it would be necessary to relocate <br /> owls, a burrowing owl habitat mitigation plan shall also be prepared and submitted to DFG for <br /> approval. This plan shall include the provision of replacement habitat for the loss of burrowing owl <br /> habitat, consistent with the DFG Guidelines for the burrowing owl. In lieu of habitat replacement, <br /> the developer may pay a fee to the San Joaquin County Council of Governments pursuant to the <br /> "San Joaquin County Multi-Species Habitat Conservation and Open Space Plan." If possible, the <br /> burrowing owl surveys shall be conducted during the winter preceding construction so that take- <br /> avoidance measures can be implemented. <br /> b. SWAINSON'S HAWK: A Swainson's hawk nest survey shall be conducted on the project site and <br /> within 0.5 mile of the site. If an active nest is found on the project site, or within a one-half mile <br /> zone of influence, project-related disturbance shall be prohibited during critical phases of the <br /> nesting cycle (March 1 — September 15 annually). Disturbance will be ascertained by a qualified <br /> raptor biologist and DFG. The project applicant shall replace any affected Swainson's hawk <br /> foraging habitat within one mile of a nest site with one acre of suitable Habitat Management Land t <br /> (1:1 impact to replacement ratio). Impacts that occur to Swainson's hawk foraging habitat greater <br /> than one mile from a nest site, but less than five miles, shall be replaced within three-quarter of an <br /> acre of Habitat Management Land (11 : '/impact to replacement ratio).
