VR-00-4 OF PAUL & BARBARA COVEY <br /> The applicants have submitted the above referenced application requesting a Variance <br /> to reduce the minimum parcel size and the minimum lot width requirements in the Low <br /> Density Residential Zone. There is already an approved Tentative Map on file (MS-00- <br /> 30) for the subdivision of the subject parcel under the Density Bonus provisions of the <br /> Development Title, Section 9-315. This Section permits the creation of parcels which do <br /> not meet the minimum standards for lots in residential zones in exchange for continued <br /> affordability of all lower income density bonus units. <br /> If the Planning Commission approves the Variance, the applicant will apply fora <br /> Revision of Approved Actions to remove the requirement for a Continued Affordability <br /> Agreement. If the Variance is denied the applicant may record a parcel map with the <br /> Continued Affordability Agreement in place. <br /> The applicant states that the Continued Affordability Agreement creates an undue <br /> I <br /> burden on the developer and buyer because potential fenders consider the Agreement a <br /> "cloud" on the title. <br /> The project site is located on the southeast corner of Myrtle Street and Anteros Ave., <br /> east of Stockton. <br /> This application is scheduled to be heard by the Planning Commission on December 7, <br /> 2000. The Community Development Department has reviewed the proposed Variance <br /> application and will be recommending that it be denied based on the inability to make all <br /> of the required findings in the affirmative. <br /> Findings for Variance: <br /> 1. Because of special circumstances applicable to the property, including size, shape, <br /> topography, location, or surroundings, the application of the regulation deprives the <br /> property of privileges enjoyed by other properties in the vicinity and under identical <br /> zoning classification. <br /> i <br />
