The local permitting agency <br /> has the jurisdiction for requiring and approving vent systems. If a well is <br /> within 50 feet of a proposed structure and under a hardscape (e.g., cement <br /> .. or asphalt) improvement that leads directly to the proposed structure, <br /> several options are available to help prevent possible future leakage of gas <br /> from migrating directly to and into the structure. One option is to make a <br /> recommendation for installing a vent system. A second option is to <br /> recommend additional surface mitigation for the proposed structure (e-g., an. <br /> impermeable membrane or passive collection system, etc.). A third option <br /> is to maintain a minimum 3-foot wide landscaped area between the well and <br /> the proposed structure. <br /> ., The Division should be aware of local jurisdictional requirements and an <br /> attempt to adopt those should be considered. <br /> N. The Construction Site Plan Review usually has an expiration date of one <br /> year from the date of the review at the discretion of the District Deputy or <br /> local permitting agency. <br /> O. The local permitting agency should be notified if contaminated soil is <br /> discovered on a project site. <br /> 1. When contaminated soil is discovered either by the applicant or a <br /> Division inspector, the phrase "Contaminated soil was found in proximity <br /> to the well' should be used as a comment on the Construction Site Plan <br /> Review. The following statement should be included on all cover letters: <br /> "Division policy requires that soil contaminated by hydrocarbons shall be <br /> remediated or disposed of in accordance with local, state, and/or federal <br /> laws. If any saturated soil or seepage is detected during construction, <br /> contact the Division immediately." <br /> 2. When contaminated soil is discovered after the Division has issued a <br /> Construction Site Plan Review letter, a follow-up letter should be sent to <br /> the local permitting agency and plan checker (see Exhibit 181.2, Item 8). <br /> ` Attach a copy of the original Plan Review letter for reference. <br /> 3. The following statement should be included on all cover letters: "If an <br /> unrecorded well is discovered during the construction process, the <br /> Division must be notified immediately.
