Jan 21 05 05: 45P
181.2 (Continued) 181.2
M. The Division should make a recommendation for a vent system when a well
is within 10 feet or under a proposed structure. The local permitting agency
has the jurisdiction for requiring and approving vent systems. If a well is
within 50 feet of a proposed structure and under a hardscape (e.g., cement
.. or asphalt) improvement that leads directly to the proposed structure,
several options are available to help prevent possible future leakage of gas
from migrating directly to and into the structure. One option is to make a
recommendation for installing a vent system. A second option is to
recommend additional surface mitigation for the proposed structure (e-g., an.
impermeable membrane or passive collection system, etc.). A third option
is to maintain a minimum 3-foot wide landscaped area between the well and
the proposed structure.
., The Division should be aware of local jurisdictional requirements and an
attempt to adopt those should be considered.
N. The Construction Site Plan Review usually has an expiration date of one
year from the date of the review at the discretion of the District Deputy or
local permitting agency.
O. The local permitting agency should be notified if contaminated soil is
discovered on a project site.
1. When contaminated soil is discovered either by the applicant or a
Division inspector, the phrase "Contaminated soil was found in proximity
to the well' should be used as a comment on the Construction Site Plan
Review. The following statement should be included on all cover letters:
"Division policy requires that soil contaminated by hydrocarbons shall be
remediated or disposed of in accordance with local, state, and/or federal
laws. If any saturated soil or seepage is detected during construction,
contact the Division immediately."
2. When contaminated soil is discovered after the Division has issued a
Construction Site Plan Review letter, a follow-up letter should be sent to
the local permitting agency and plan checker (see Exhibit 181.2, Item 8).
` Attach a copy of the original Plan Review letter for reference.
3. The following statement should be included on all cover letters: "If an
unrecorded well is discovered during the construction process, the
Division must be notified immediately. Plugging and abandonment or
reabandonment requirements will be determined at that time."
M0118118 February 2004
