The loss of foraging habitat for these special status bird species would be considered less than <br /> significant because of the regional abundance of similar habitats,the current status of the species(i.e.,the <br /> populations of these species are not in"immediate jeopardy'),and the lack of breeding habitat for these <br /> species on the subject site. Consequently,the proposed Project is not expected to substantially affect <br /> these species. Additionally,implementation of mitigation measures identified for loss of Swainson's <br /> hawk foraging habitat(see Impact F.3),including proximate off-site land acquisition,enhancement,and <br /> preservation, and for the filling of the North Branch of the South Fork of Little Johns Creek(see Impact <br /> F.1)would simultaneously provide replacement habitat for the California homed lark,mountain plover, <br /> northern loggerhead shrike,and northern harrier,all of which share similar foraging habitat requirements. <br /> Implementation of Mitigation Measures F.1 and F.3 would reduce the <br /> Mitigation Measure F (a) Impleme <br /> impact to a less than significant level. <br /> Implementation of the proposed project would continue or slightly increase existing <br /> Impact F.6. p P P <br /> levels of night lighting of the site. <br /> Under current project plans,night lighting of portions of the landfill (e.g.,the location of the scale house) <br /> may be required. Given existing levels of on-site human activity and disturbance, increased night lighting <br /> isnot expected to substantially affect wildlife species on the site and would not be considered a <br /> significant impact under the State CEQA Guidelines. Implementation of the following measures would <br /> further decrease the magnitude of this impact. <br /> Mitigation Measure F.6. (a) The project proponent shall minimize the use of lighting at night If night <br /> lighting is required,sodium lamps with sharp cutoff angles are recommended to focus light in active <br /> landfill areas(target areas) and to avoid nighttime lighting of adjacent open areas and valley oak trees. <br /> Such lighting often discourages presence of nocturnal wildlife species(e.g.,owls,mice) as it renders prey <br /> species more susceptible to predation. This less than significant impact would be further reduced with the <br /> above mitigation measure. <br /> New Impacts Not Identified in the 1994 EIR: <br /> Impact F.7.Conversion of 213.9 acres of Agricultural Lands to other uses could result in <br /> "incidental take" of special status species covered by the SJMSCP. <br /> Agricultural Lands,such as the Brocchini property(80.5 acres)and the CYA and triangular properties <br /> (133.4 acres),provide breeding and foraging habitat for several special-status species covered by the <br /> SJMSCP. The SJMSCP specifies that conversion of such lands could result in incidental take of these <br /> species according to the State and Federal Endangered Species Acts. Therefore, agricultural conversion is <br /> subject to both a mitigation requirement(payment of fees to fund the acquisition of open space preserves) f <br /> as well as a impact minimization requirement(implementation of specific avoidance measures described �•l <br /> elsewhere in this section). This issue is mitigated by the SJMSCP,as discussed below. Implementation <br /> of the following mitigation measure would reduce the this impact to a level considered less than } <br /> significant. {� <br /> Mitigation Measure F.7 (a) According to the SJMSCP,the mitigation fee for conversion of <br /> Agricultural Lands to other uses is$1,500 per acre. For the conversion of 213.9 acres of Agricultural <br /> Lands,the property owners,developers,or their successors at interest shall pay$320,850 or other fees as <br /> calculated by the SJMSCP Joint Powers Authority (JPA)to the JPA to fund acquisition of preserve lands <br /> for covered species that could potentially be affected. <br /> GRASS'ETTI ENVIRONMENTAL CONSULTING <br />
