y. <br /> Proposed project site is subject to the Agricultural Resource Management Zone: The proposed request is <br /> to amend the current facilities waste boundary only and no additional landfill activities will occur in the 184 <br /> acres. The site is currently zoned AG-40 (General Agriculture, 40-acre minimum) and has not been <br /> rezoned to(ARM)Agricultural Resource Management. <br /> Cumulative impacts when combined with other anticipated development: The proposed request is to amend <br /> the current facilities waste boundary only and update the landfill gas probe monitoring system no additional <br /> landfill activities will occur in the 184 acres. The cumulative effects of the proposed request, together with <br /> existing, approved and likely development have been reviewed. The initial study found no potentially <br /> significant impacts or cumulative impacts and a Negative Declaration was posted. <br /> Williamson Act <br /> The proposed solid waste facility boundary amendment if approved will encompass 184 acres of <br /> agricultural land under Williamson Act Contract No. 72-C1-398. Forward, Inc. served a Notice of <br /> Nonrenewal for Williamson Act Contract No. 72-C1-398, on October 13, 2005. The Notice of Nonrenewal <br /> was recorded with the San Joaquin County Recorder's Office as Document No. 2005-256394 on October <br /> 13, 2005. Pursuant to the Notice of Non-Renewal, the Williamson Act contract on the subject property <br /> will expire on March 1, 2015. However, expansion into the 184 acres is not permitted at this time and this <br /> will not be a conversion of the contracted land because no increase in waste placement will occur under <br /> this application. Additionally, in a letter dated December 15, 2010 the Department of Conservation did <br /> not raise any issues or concerns with the proposed request, as the proposed request is not to expand the <br /> current permitted refuse footprint on to the 184 acres of contracted land. <br /> Airport Land Use Plan and Adopted Plans <br /> The project site boundaries and proposed amended boundaries fall within the comprehensive airport land <br /> use plan for the Stockton Metropolitan Airport. The nearest runway of the Stockton Metropolitan Airport is <br /> one mile west of the existing Forward Landfill. This application is to amend the existing solid waste facility <br /> permit boundaries only under Title 27 CCR (California Code of Regulations) and is not for additional <br /> waste placement or disposal. Expansion into the undeveloped southwest area of the current permitted <br /> landfill site is not permitted. Therefore, the proposed facility boundary amendment will have less than a <br /> significant impact on airport imaginary surfaces. A letter dated December 9, 2010 was received from the <br /> Airport Land Use Commission (ALUC) stating the ALUC will consider this project as a consistent land use <br /> under the 1993 Airport Land Use Plan for Stockton Metropolitan Airport. The project is also consistent <br /> with the Countywide Integrated Waste Management Plan and no additional Master Plan, Specific Plan or <br /> Special Purpose Plan are applicable to this solid waste facilities boundary amendment application. <br /> San Joaquin County PA-10002451Forward,Inc. <br /> Community Development Page 6 <br />
