'r <br /> Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration;and <br /> 2. Approve Use Permit No. PA-1000245 with the Findings,and Conditions of Approval contained in <br /> the Staff Report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan; <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan;and any other applicable <br /> pian adopted by the County. <br /> This finding can be made because the proposed landfill boundary modifications are <br /> consistent with the objective and policies of the General Plan relative to Solid Waste <br /> Disposal (Volume 1, IV-111). The project is consistent with the General Plan's Hazardous <br /> Materials and Waste Objectives 1 and 2 (Volume I, V-12). The project is also consistent <br /> with the Countywide Integrated Waste Management Plan and no Master Plan, Specific Plan <br /> or Special Purpose Planis applicable to this project. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other <br /> necessary facilities have been provided, and the proposed improvements are properly related to <br /> existing and proposed roadways. <br /> This finding can be made because the site has frontage on Austin Road,and the <br /> 3 provisions of drainage, utilities,water, and sanitation are approved under the previous <br /> Conditions of Approval for Use Permit application UP-00-0007 which consolidated the <br /> former Austin Landfill and Forward Landfill into one operation. No additional facilities or <br /> services are proposed with this application. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> This finding can be made because the application is to amend the existing Solid Waste <br /> Facility Permit Boundaries only. No landfill activities,waste placement,disposal,composting, <br /> storage of equipment, or soil borrowing will occur on the 184 acres. No increase in current <br /> permitted daily tonnage or land refuse footprint will occur under this application. <br /> 4, Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare <br /> or be injurious to the property or improvements of adjacent properties. <br /> This finding can be made can be made because the Initial Study prepared for the proposed <br /> landfill boundary amendment found no potentially significant environmental impacts. <br /> San Joaquin County PA-10002451Forward,lnc. <br /> Community Development rage 7 <br />
