• <br /> • Draft Supplemental Environmental Impact Report Page IV.A-13 <br /> Forward Inc.Landfill 2018 Expansion Project <br /> • <br /> • restrictions and conditions outlined in U.S. Code Title 49, Subtitle VII, Part A, Subpart iii, Chapter 447, <br /> • Section 44718, 40 CFR Section 258.10;FAA Advisory Circular 150/5200-34A or subsequent advisory <br /> (Construction or Establishment of Landfills Near Public Airports);FAA Advisory Circular 15015200- <br /> 33B or subsequent advisory, (Hazardous Wildlife Attractants On or Near Airports)."2 <br /> • <br /> • The bird survey results, described under the Bird Strikes and Gull Survey Evaluations section, <br /> • above, have shown that, through monitoring, evaluations, and implementation of the gull <br /> program, the landfill has continued to not create a bird hazard to aircraft at the Stockton <br /> • Airport. With the adopted and existing land use measures in place to prevent potential bird <br /> • strikes, the gull control program continues to be successful, therefore ensuring compatibility of <br /> • existing landfill operations and the proposed expansion areas for land uses located within the <br /> • Conical Surface Zone for the Stockton Airport. <br /> • San Joaquin County General Plan <br /> The Public Facilities and Services Element of the San Joaquin County General Plan Policy <br /> Document (adopted in December 2016) contains the following goal and policies: <br /> • <br /> • GOAL TM-8. To ensure that the air transportation system accommodates the growth of air <br /> • commerce and general aviation needs within the parameters of compatible surrounding uses. <br /> • TM-8.5 Compatible Land Uses. The County shall require that only compatible land uses be <br /> • permitted near airports, in accordance with the Airport Land Use Plan. (RDR) <br /> TM-8.6 Airport Operations. The County shall ensure that airport operations are protected <br /> from: <br /> • • projections of structures into navigable airspace, <br /> • • light and glare, <br /> • 0 emissions affecting visibility; <br /> • • interference with communications, and <br /> • • bird hazards,such as from ponds and landfills. (RDR) <br /> • EPA and FAA Regulations <br /> • <br /> • A U.S. EPA regulation, found at 40 Code of Federal Regulations section 258.10, requires that any <br /> • landfill operator proposing expansion of an existing landfill within 10,000 feet of any runway <br /> • used by turbojet aircraft or within 5,000 feet of any runway used only by piston-type aircraft <br /> must demonstrate that the landfill expansion will not pose a bird hazard to aircraft.
