Landfill 2018 Expansion Project <br /> • <br /> Therefore, this EPA regulation applied to the previously proposed expansion project, which • <br /> was located within 10,000 feet of the SMA runway. (Hunt, 2010.) The 2018 Expansion Project is • <br /> not located within 10,000 feet of the SMA runway, and is not subject to this EPA regulation. In <br /> any case, the Forward Landfill has prepared this demonstration (Davis, 2011), and had placed • <br /> this demonstration in the Landfill operating record and so notified U.S. EPA. (Basso, 2011.) • <br /> EPA regulation (40 Code of Federal Regulations section 258.10) also requires that the operator • <br /> of an existing landfill proposing a lateral expansion of that landfill within 5 miles of an airport • <br /> runway must provide notice of the proposed expansion to the director of the lead state agency • <br /> responsible for implementing the state permit program under 40 CFR part 257, subpart B and 40 • <br /> CFR part 258 for facilities regulations under these regulations--in California, it is the Director • <br /> of the California Department of Resources Recycling and Recovery or "Cal Recycle'. This <br /> notification was provided to CalRecycle. (Basso 2018d, 2018e.) • <br /> Title 14 of the Code of Federal Regulations,Part 77 contains the Federal Aviation <br /> Administration's regulations that establish standards for determining obstructions to navigable <br /> airspace and the effects of such obstructions on the safe use of airspace. 14 Code of Federal • <br /> Regulations,Section 77.7 prescribes the form of notice that must be given to the FAA regarding • <br /> proposed landfill expansions. • <br /> Forward, Inc. submitted preliminary plans to the Federal Aviation Administration and received <br /> a "Determination of No Hazard to Air Navigation" on October 12,2017, consisting of seven • <br /> letters stating that the various portions of the proposed project "not exceed obstruction • <br /> standards and would not be a hazard to air navigation". (McDonald, 2017a;McDonald, 2017b, • <br /> McDonald, 2017c;McDonald, 2017d;McDonald,2017e;McDonald, 2017f, McDonald, 20178.) <br /> • <br /> Lighting Impacts • <br /> The Board of Supervisors approved Use Permit application UP-00-0007 in April 2003 for <br /> Forward to combine the former Austin Road Sanitary Landfill and the Original Forward <br /> Landfill into a single Forward Landfill. The Final EIR for that project identified a mitigation • <br /> measure that stipulates that lighting for nighttime operations at the working face and other • <br /> landfill facilities shall consist of sodium lamps with sharp cutoff angles and downward • <br /> shielding, and to the extent feasible, shall be oriented in a direction that is not visible from off- <br /> site locations. This mitigation measure is included in the Mitigation Monitoring and Reporting • <br /> Program that has been updated annually since the consolidation project was approved. In • <br /> addition to the stipulations of the mitigation measure, the County has requested that all landfill • <br /> lights face to the west to avoid confusion for incoming aircraft. According to the most recent • <br /> monitoring report, completed on April 17,2018, Forward Landfill has complied with this <br /> mitigation measure since 2003, and has not received any non-compliance reports for lighting • <br /> hazards to aircraft navigation. • <br /> Countywide Integrated Waste Management Plan <br /> State law (AB 939) requires counties to prepare a Countywide Integrated Waste Management • <br /> Plan (CIWMP), containing a Source Reduction and Recycling Element(SRRE), a Household • <br /> • <br /> • <br /> • <br /> • <br />
