Prior to site grading, the project sponsor shall conduct an updated <br /> • jurisdictional delineation. The updated jurisdictional delineation shall specifically address the <br /> creek, but also address any onsite storm control features (detention basins, dry ditches) that <br /> • could be jurisdictional. Prior to site grading, the project sponsor shall also obtain permits under <br /> • Sections 401 and 404 of the Clean Water Act and Section 1602 of the California Fish and Game <br /> • Code for all impacts to jurisdictional resources. These permits, administered by the RWQCB, <br /> • USACE, and CDFW, respectively, would specify the mitigation measures to be imposed on the <br /> project as permit conditions. A Wetland Mitigation and Monitoring Plan shall be prepared and <br /> • submitted for agency review to ensure a"no net loss" of wildlife value or acreage of wetlands <br /> • or riparian habitat. At a minimum, the Plan shall include the creation of the equivalent acreage <br /> • of wetlands and riparian habitat present (as determined by the updated jurisdictional <br /> delineation to be conducted), or as required by regulatory agencies. The Project Sponsor shall <br /> • ensure that all mitigation areas, along with an appropriate upland buffer,be placed in a <br /> • permanent conservation easement, or similar deed restriction, and preserved in perpetuity. <br /> The Wetland Mitigation and Monitoring Plan shall include the following details: <br /> • • The location(s) of mitigation areas, including the types and extent of each habitat type to be <br /> created. <br /> • • Mitigation for loss of existing wetlands shall at a minimum include the equivalent acreage <br /> • of wetlands and riparian habitat present(as determined by the updated jurisdictional <br /> • delineation to be conducted), or as required by regulatory agencies (expected 3:1 <br /> • replacement ratio). Riparian habitat mitigation may occur through off-site mitigation to <br /> • address Federal Aviation Administration (FAA) concerns regarding increasing the risk of <br /> increased bird use and associated aviation risks. <br /> • All graded or filled areas within the habitat restoration area shall be seeded with <br /> • appropriate mixes of native grass and forb species, developed by a qualified restoration <br /> • ecologist. <br /> • Restored wetlands and riparian habitat shall have an equal or higher habitat value; <br /> • A water budget shall be prepared analyzing water demand for each mitigation habitat type <br /> • and the ability of the watershed to support the target habitats. <br /> • • The stated goal of the mitigation effort shall be to establish self-sustaining native riparian <br /> • vegetation that shall not require long-term irrigation or maintenance. <br /> • The mitigation site shall include the establishment of a vegetated upland buffer no less than <br /> • 50 feet wide on both sides of the recreated channel, where practicable. <br /> • Provide grading details, analysis of site hydrology and its ability to support the proposed <br /> • riparian vegetation, location and quantities of all plant materials to be installed, native seed <br /> • mixes to be used on all bare ground surfaces, monitoring procedures and schedules, <br /> • identification of remedial measures, and performance criteria to be used by the agencies to <br /> • assess success or failure of the mitigation effort. <br /> • • Long-term monitoring of at least five years shall be funded by the Project Sponsor, subject to <br /> • approval by the regulatory agencies. <br /> • • Annual monitoring reports shall be submitted to each permitting agency. <br /> • <br /> • <br /> • <br /> • <br />
