d) MITIGATION MONITORING AND REPORTING PROGRAM: The project shall comply with all <br /> required mitigations included in the MMRP dated January 2023. The project applicant shall <br /> comply with the attached Mitigation Monitoring Program, (Attachment `B') (MITIGATION <br /> (MONITORING AND REPORTING PROGRAM 2018 FORWARD LANDFILL EXPANSION <br /> PROJECT))_The applicant and the Community Development Department shall annually review the <br /> program. Not less than 30 days nor more than 60 days prior to the first anniversary date of this <br /> approval, and each anniversary date thereafter, the applicant shall submit to the Community <br /> Development Department a letter setting forth the applicant's good faith compliance with the terms <br /> and conditions of the program. Community Development Department staff will visit the site semi- <br /> annually. All costs incurred by the Community Development Department for the semi-annual <br /> monitoring and the annual review shall be borne by the applicant. The costs may include costs of <br /> Community Development Department staff and administrative time and direct out-of-pocket costs <br /> and expenses, including costs of consultants and non-department personnel. If any suspected Tribal Cultural Resources (TCR) are discovered during ground disturbing <br /> construction activities, all work shall cease within 100 feet of the find. A Tribal Representative <br /> from culturally affiliated tribes shall be immediately notified and shall determine if the find is a <br /> TCR pursuant to Public Resources Code Section 21074. <br /> 2_ Preservation in place is the preferred alternative under CEQA and North Valley Yokuts Tribe <br /> protocols, and every effort must be made to preserve the resources in place, including through <br /> project redesign.Work at the discovery location cannot resume until all necessary investigation <br /> and evaluation of the discovery under the requirements of CEQA, including AB 52, has been <br /> satisfied. <br /> 3. The contractor shall implement any measures deemed by the lead agency to be necessary and <br /> feasible to preserve in place, avoid or minimize impacts to the resource, including but not <br /> limited to facilitating the appropriate tribal treatment of the find as necessary. <br /> 4.
