Emission Reduction Credits <br /> The District requires that the use of Emission Reductio►► Credits as a <br /> rr►itigation measure he made also fully onfoeceable by the County if they are <br /> not required by District Rule 2201. <br /> The DSEIR proposes to mitigate operational emissions from stationary sources <br /> with implementation of Mitigation Measure 0.2a, which states that the Project <br /> proponent would acquire emission offsets as required by the regulations of <br /> 0 District Rule 2201 (New and Modified Stationary Source Review) in accordance <br /> with District Rule 2301 (Emission Reduction Credit Banning). <br /> It is important to note that, even after the Project goes through District permitting <br /> processes, Rule 2201 may not require offsets to be provided for the Project. <br /> In the event that any Criteria Pollutant emissions resulting from stationary <br /> sources do not require offsets per the requirements of District Rule 2201, the use <br /> of Emission Reduction Credits as a mitigation measure must be made fully <br /> enforceable through San Joaquin County (e.g. as a condition of approval)_ <br /> D. District Rule 2010 (Permits Required) <br /> The District recommends that the Project proponent contact the District <br /> regarding District Rule 2010, which applies to this Project. <br /> As stated in the DSEIR (Page IV 0-9), the Project is subject to District Rule 2201 <br /> (New and Modified Stationary Source Review), Rule 4102 (Nuisance/Odors), and <br /> Reguotion VIII (Fugitive PM10 Prohibitions/Dust). The Project is also subject to <br /> District Rule 2010 (Permits Required). This facility is currently permitted with the <br /> District (N-339 Forward Inc. Landfill), and any modification that would result in a <br /> change in emissions or change in method of operation/equipment requires the <br /> O submittal of an Authority to Construct (ATC) Permit application. As such, the <br /> District recommends that the Project proponent contact the District's Small <br /> Business Assistance (SBA) office to determine whether an ATC and Permit to <br /> Operate (PTO) are required for this Project.
