Emission Reduction Credits The District requires that the use of Emission Reductio►► Credits as a rr►itigation measure he made also fully onfoeceable by the County if they are not required by District Rule 2201. The DSEIR proposes to mitigate operational emissions from stationary sources with implementation of Mitigation Measure 0.2a, which states that the Project proponent would acquire emission offsets as required by the regulations of 0 District Rule 2201 (New and Modified Stationary Source Review) in accordance with District Rule 2301 (Emission Reduction Credit Banning). It is important to note that, even after the Project goes through District permitting processes, Rule 2201 may not require offsets to be provided for the Project. In the event that any Criteria Pollutant emissions resulting from stationary sources do not require offsets per the requirements of District Rule 2201, the use of Emission Reduction Credits as a mitigation measure must be made fully enforceable through San Joaquin County (e.g. as a condition of approval)_ D. District Rule 2010 (Permits Required) The District recommends that the Project proponent contact the District regarding District Rule 2010, which applies to this Project. As stated in the DSEIR (Page IV 0-9), the Project is subject to District Rule 2201 (New and Modified Stationary Source Review), Rule 4102 (Nuisance/Odors), and Reguotion VIII (Fugitive PM10 Prohibitions/Dust). The Project is also subject to District Rule 2010 (Permits Required). This facility is currently permitted with the District (N-339 Forward Inc. Landfill), and any modification that would result in a change in emissions or change in method of operation/equipment requires the O submittal of an Authority to Construct (ATC) Permit application. As such, the District recommends that the Project proponent contact the District's Small Business Assistance (SBA) office to determine whether an ATC and Permit to Operate (PTO) are required for this Project.
