Landfill Expansion Project MMRP <br /> The project sponsor shall comply with the requirements applicable to existing landfills <br /> contained in Federal Aviation Administration(FAA)Advisory Circulars 150/5200-33B, I <br /> Hazardous Wildlife Attractants on or Near Airports,and 150/5200-34A, Construction or <br /> Establishment of Landfills Near Public Airports. Requirements in Advisory Circular <br /> 150/5200-33B applicable to the proposed project include notification of the FAA and airport, ' <br /> and a demonstration that the landfill is designed and operated so it does not pose a bird <br /> hazard to aircraft. Forward notified the Stockton Metropolitan Airport and FAA by letter on <br /> July 6,2018 (Basso,2018a.The effectiveness of the gull control program at the existing ' <br /> landfill in avoiding bird hazards to aircraft is discussed under IV.A Surrounding and Nearby <br /> Land Uses, and the demonstration that the site will not pose a bird hazard to aircraft was <br /> placed in the operating record by letter on July 6,2018.Advisory Circular 150/5200-34A <br /> applies only to establishment of new landfills near airports, and does not apply to the ' <br /> proposed project. <br /> The project sponsor will abide by any additional reasonable and feasible measures designated ' <br /> by the Stockton Metropolitan Airport or the FAA to mitigate bird population impacts that <br /> could be caused by the proposed project. <br /> 4. (A.4)Identified in this EIR: ' <br /> The project sponsor shall implement an annual gull control program as described in Rolph A. <br /> Davis,Ph.D. LGL Limited Environmental Research Associates, Demonstration of the <br /> Effectiveness of the Bird Control Program at the Forward Landfill,Manteca,California— ' <br /> 2016-2017,August 7,2017. <br /> The gull control program shall include monitoring of gulls feeding at or using the landfill,as ' <br /> described below. <br /> • Monitoring shall be conducted by an independent third-party firm or individual with <br /> experience in the field of bird hazards to aircraft safety. ' <br /> • The third-party monitoring shall consist of a minimum of six site visits, each lasting <br /> four hours, every month from October through May. To the extent possible,the site ' <br /> visits shall be announced in advance. During each month: <br /> o two of the visits shall begin at dawn, <br /> o two shall occur during mid-day, ' <br /> 0 one shall occur late in the afternoon covering the period after the falconer has <br /> finished for the day, and <br /> 0 one shall occur on Sunday when the landfill is closed to ensure that gulls are <br /> not accessing the site when staff are absent. ' <br /> • Site visits in addition to the minimum of six monthly visits described above shall be <br /> made if necessary to verify the criteria for failure described below. ' <br /> • The results of the monitoring shall be documented in an annual report. <br /> • Landfill staff shall participate in monitoring so that action can be taken as soon as a ' <br /> potential problem is identified. <br /> The control program shall be considered to be failing and will require upgrading if any of the ' <br /> following situations occur: <br /> Page 4 <br />
