Forward Inc. Landfill Expansion Project MMRP (a)Heavy equipment operations shall not be conducted within 1,500 feet of any occupied residence after 10 p.m. and before 7 a.m.; or ' (b)Equipment operations within 1,500 feet of any residence after 10 p.m. or before 7 a.m. shall be fully shielded from the direct line of sight to the residence by an earthen berm whose crown elevation exceeds the elevation of the top of the exhaust stack. 14. Forward 1993(E3) ' The landowner and tenant at RI (residence at 9690 Austin Road) shall be provided with the option of requesting a sound wall to reduce noise exposure both in the front yard and within the home. Table III.E.B in the Draft EIR shows the noise reduction provided by a variety of different sound wall designs. The footnotes to Table X..E.B describe the alternative designs ' in detail). Note that any of these designs will be more than sufficient to reduce project noise impacts below a level of significance. 15. Forward 1993 (El) ' The contractor shall be required to employ the quietest among alternative equipment or to mufflelcontrol noise from available equipment. 16. Forward 1993 (E2) Muffling of equipment used on site shall be maintained to factory specifications. 17.Austin 1994(H].a) (similar),Austin 2000(H].a) The proposed project must conform to the San Joaquin County Noise Standards contained in the County's General Plan. The project sponsor shall be required to demonstrate ' compliance with this performance standard. Work areas could be limited, work times close to the residence could be rescheduled, noise barriers such as earth berms could be designed, and noise monitoring shall be undertaken to demonstrate compliance in the event noise complaints are received. 18.Austin 1994(H].b),Austin 2000(H].b) If project-related noise levels measured at the property line of any residential use would exceed an hourly average of 45 dBa during the nighttime or 55 dBa during the daytime, then setbacks and a limitation on hours of operations shall be mandatory. As recommended in the Forward, Inc. Landfill Use Permit Modifications, the option of a soundwall at 9690 Austin ' Road shall be available to the resident. D.AIR QUALITY/ODORS 19(D.1)Identified in 2013 EIR and Modified in this SEIR: The applicant shall comply with Regulation VIII and implement the following control measures during construction: ' • The applicant shall submit a Dust Control Plan subject to review and approval of the SJVAPCD at least 30 days prior to the start of any construction activity on a site that includes 40 acres or more of disturbed surface area.
