The
applicant's JTD describes creating a wedge of landfill material north of
WMU-A that would keep a buffer area around the WMU-A boundaries
clear of new refuse and then start to build outward and upward. This plan
must have the approval of CalRecycle and RWQCB.
Current Status: The current Forward Landfill Postclosure Permit for
WMU A allows only post-closure monitoring, inspection, and
maintenance activities on WMU A and, therefore, would not allow
expansion of new landfill areas above WMU A. In addition, according to
the Department of Toxic Substances, "The postclosure permit includes
provisions to restrict future land uses. Any future new use of the site will
also require an amendment of the postclosure permit, pursuit to the
specific conditions stated therein. Deed restrictions are also in place that
limit future use of the property and provide notice of its former
hazardous waste landfill uses" (ref: letter to the Office of Planning and
Research regarding Notice of Exemption from CEQA, June 30, 1993).
CalRecycle and RWQCB have approved Forward's site development
plan as presented in the JTD. The site development plan includes
creating a wedge of landfill material north of WMU-A that would keep a
buffer area around the WMU-A boundaries clear of new refuse and then
start to build outward and upward.
9.
