(1) The homesite shall not be transferred until June 16, 2023, or upon the death of an <br /> owner owning at least fifty (50) percent interest in the homesite parcel, unless the <br /> homesite parcel and the remainder parcel are merged pursuant to the provisions of the <br /> Development Title. <br /> (2) The property shown on the Parcel Map is restricted from further subdivisions for <br /> homesite purposes, except for financing only, by Section 9-610.3 of the San Joaquin <br /> County Development Title. <br /> g. NOISE: If noise sensitive development is proposed within 218 feet from the edge of the Union Pacific <br /> Railroad along the westerly portion of Parcel 2 and the Designated Remainder, then a noise study <br /> shall be required prior to noise sensitive development and construction must comply with <br /> recommended mitigation measures to achieve compliance with the standards specified in Table 9- <br /> 1025.9. (General Plan Table III.D-7B, Volume III, page IIID-46) (Development Title Section 9- <br /> 1025.9(a)[1]) (Development Title Section 9-1025.9(d)[4]) <br /> 2. COUNTY COUNSEL <br /> HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the subdivider <br /> shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from <br /> any claim, action, or proceeding against the local agency or its agents, officers, or employees to attack, <br /> set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative <br /> body concerning a subdivision, which action is brought within the time provided for in Section 66499.37 of <br /> the Government Code. <br /> 3.
