SOIL RECONSTRUCTION PLAN: The reclaimed land surface shall'be no less than 12 feet <br /> above the high level of the water table. The final reclaimed upper five feet of material shall <br /> consist of the following: a minimum fine grained soil content of 30%, a maximum sand <br /> content of 20%, and a maximum gravel content of 20% recorded on a minimum of 90% of <br /> samples taken at a depth of one foot beneath the reclaimed surface, The samples shall also <br /> be tested for organic matter with a minimum requirement of 1%. All recommendations of the <br /> Re-Soiling, Revegetation, and Erosion Control Plan (contained as Appendix D of the Final <br /> EIR)shall be enforced as appropriate during the life of the mine. <br /> U. SEISMIC SAFETY: If strong seismic shaking is experienced at the project site as the <br /> result of a moderate to large earthquake (M 6 or greater) along the CRSBBZ, the project <br /> site shall be inspected by a qualified licensed civil or geotechnical engineer to determine <br /> f if liquefaction or seismic subsidence has occurred and resulted in visible damage to <br /> t reclaimed lands. A report, including recommendations to repair any damage that may <br /> have occurred, shall be submitted to the Development Services Division for review and <br /> approval. Upon approval by the Department Services Division, the proponent shall <br /> implement the recommendations set forth in the report. <br /> v. CULTURAL RESOURCES: The excavator shall cease all construction and excavation <br /> work immediately upon the discovery of cultural resource materials. Such work shall <br /> cease until the excavator has compiled with the requirements of Appendix K of the <br /> CEQA Guidelines. <br /> W. ENFOkCEMENT: Except as otherwise provided in State Mining Regulations, the <br /> County shall have authority to enforce provisions of the Surface Mining and Reclamation <br /> Act. The County may exercise all enforcement regulations available under the County <br /> Development Title and the State Public Resources Code. Such enforcement measures <br /> include charging the applicant the costs of administering an enforcement action.. The <br /> basis for charging fees for an enforcement action shall be a time and materials <br /> compensation. (Development Title Section 9-1415.2[t]) <br />
