C <br /> 24 <br /> Criteria for Evaluation of Cultural Resources <br /> Pursuant to current archaeological requirements, instigation <br /> of the proposed project, which invoked the investigations <br /> presented in this report, requires compliance with specific laws <br /> and processes, primarily CEQA. A major part of this process is <br /> evaluation of the potential scientific significance of historical <br /> resources. The salient aspects of this process are described <br /> informally as follows (legal counsel should be contacted for <br /> Specifics of CEQA case law) . <br /> Federal regulations for cultural resources evaluations are <br /> governed primarily by Section 106 of the National Historic <br /> Preservation Act of 1966. (Implementing regulations for Section <br /> 106 review process are given in 36 CFR 800. ) The federal <br /> regulations are intended to provide protection to sites that are <br /> determined eligible for listing on the NRHP. Federal regulations <br /> " apply only if an undertaking (project) requires a federal permit <br /> or if federal funds are involved. <br /> Archaeological sites may be assessed as "significant" under <br /> criteria of the National Register of Historic Places (NRHP) , <br /> specifically but not exclusively criterion D, which refers to <br /> sites "that have yielded, or may be likely to yield, information <br /> important in prehistory." <br /> f S <br /> Sites that meet one or more criteria of the NRHP may be <br /> determined significant and accordingly eligible for nomination to' <br /> the NRNP. Generally, a property that is assessed as eligible for. <br /> , . nomination to the NRHP is implicitly considered to be "unique" as <br /> defined in the California Environmental Quality Act (CEQA) <br /> guidelines. <br /> Most private projects are required to consider cultural <br /> �-- resources under (CEQA) when county or city construction permits <br /> are required for the project. The criteria for evaluating the <br /> "uniqueness" (or significance) of cultural resources, including <br /> archaeological sites, are given in Appendix J of CEQA's <br /> implementing guidelines.
