Y <br /> creek, to preclude the design (as defined by flood waters reaching elevation 297.1 feet in <br /> the channel created by the over crossing of Hospital Creek by Interstate 580) from <br /> overtopping the levee system at a line 250 feet to the north of the northern boundary of <br /> the CalTrans drainage easement for Hospital Creek. <br /> As appropriate, the long term (i.e., post mining) maintenance of the levee system to the <br /> north of Hospital Creek shall be under the control of an improvement zone, which is a <br /> part of the County-wide Flood Control District, a newly created County Service Area with <br /> the responsibility for maintaining the levee, or a newly created Reclamation District, <br /> which will be created prior to mining the northern mine area. <br /> s. HOSPITAL CREEK SETBACK: Brightly colored posts shall be installed every 50 feet <br /> along both sides of the Hospital Creek mining setback boundary area, which is measured <br /> 250 feet back from the centerline of the creek channel. Informational signs snail be <br /> posted every 100 feet which identify this area as restricted due to its biological <br /> sensitivity. Brightly colored posts shall also be installed on each side of the haul road on <br /> both sides of the channel in the immediate vicinity of the Hospital, Creek ford. <br /> t. SOIL RECONSTRUCTION PLAN: The reclaimed land surface shall be no less than 12 <br /> feet above the high level of the water table. The final reclaimed upper five feet of <br /> material shall consist of the following: a minimum fine grained soil content of 30% a <br /> maximum sand cntent of 20% and a maximum aravel content of 20% recorded on a <br /> j minimum of 90% of samples taken at a del2th of one foot beneath the reclaimed surface. <br /> The sam les shall also be tested for oEganic matter with a minimum requirement of 1%. <br /> All recommendations of the Re-Soiling. SEISMIC SAFETY: if strong seismic shaking is experienced at the project site as the <br /> result of a moderate to large earthquake (M B or greater) along the CRSBBZ, the project <br /> site shall be inspected by a qualified licensed civil or geotechnical engineer to determine <br /> if liquefaction or seismic subsidence has occurred and resulted in visible damage to <br /> reclaimed lands. A report, including recommendations to repair any damage that may <br /> have occurred, shall be submitted to the Development Services Division for review and <br /> approval_ Upon approval by the Department Services Division, the proponent shall <br /> implement the recommendations forth in the report. <br /> set o p <br /> V. CULTURAL RESOURCES: The excavator shall cease all construction and excavation <br /> work immediately upon the discovery of cultural resource materials. Such work shall <br /> cease until the excavator has complied with the requirements of Appendix K of the <br /> CEQA Guidelines. <br /> W, ENFORCEMENT: Except as otherwise provided in State Mining Regulations, the <br /> County shall have authority to enforce provisions of the Surface Mining and Reclamation <br /> Act. The County may exercise all enforcement regulations available under the County <br /> Development Title and the State Public Resources Cade. Such enforcement measures <br /> include charging the applicant the costs of administering an enforcement action.
