REPORT OF WASTE DISCHARGE: Submit a Report of Waste Discharge (RWD) to <br /> the Califomia Regional Water Quality Control Board 180 days prior to the start of any <br /> activity on the site. <br /> Y. INDEMNIFICATION: The owner shall defende, indemnify, and hold harmless the local <br /> agency or its agents, officers, and employees from any claim, action, or proceeding <br /> against the local agency or its agents, officers, or employees to attack, set aside, void, or <br /> annul an approval of the local agency, advisory agency, appeal board, or legislative <br /> body conceming this Quarry Excavation permit. <br /> z. ` SCREENING: During the life of the project, two offset rows of almond trees shall be <br /> maintained around the perimeter of the excavation site. <br /> aa. SITE CLEANUP. Prior to the commencement of operations north of Hospital Creek, the <br /> existing area' being mined south of Hospital Creek shall be cleaned up. The cleanup <br /> shall include the following: removal of spoils piles, formalize berms, provide uniform <br /> vegetative cover, and remove all obsolete, unused, and abandoned vehicles and mining i <br /> equipment. <br /> i <br /> 2. DEPARTMENT OF PUBLIC WORKS: (Staff Contact: Tom Iwamiya, 468-3023) <br /> a. The excavation plan shall be prepared by a Registered Civil Engineer and include the <br /> following (Development Title Sections 9-854.3 and 9-1415.2): <br /> (1) Detail of access road (first 100 feet from Bird Road shall be paved). <br /> (2) Final grading pian drainage provision. <br /> (3) Boundaries and quantities of excavation and direction of excavation for each <br /> phase. <br /> (4) Stockpile area for topsoil. <br /> b. Loads on Bird Road shall be restricted to legal loads only. (Streets and Highway Title <br /> Section 10-2350) <br /> C. A video tape of road conditions on Bird Road, along the haul route, is required prior to <br /> the start of excavation. The condition of Bird Road shall be reviewed with the <br /> Department of Public Works prior to the start of excavation and every five years <br /> thereafter. (Development Title Section 9-1415.2) <br /> d. A Maintenance Agreement, along with a bond or cash deposit in the amount acceptable <br /> to the Department of Public Works, shall be required to ensure that if the permittee fails, <br /> refuses, or neglects to repair, under permit, any damages to Bird Road that may result <br /> from permittee's operations, the Department of Public Works may do the work necessary <br /> to restore Bird Road. from the project's entrance to the southem terminus of Teichert <br /> Aggregates' Bird Road reconstruction, equal to or better than its original condition, using <br /> the funds from said bond or cash deposit, subject to review and adjustment for inflation <br /> every five years.
