F <br /> r <br /> CONDITIONS OF APPROVAL <br /> QX-01-1 <br /> Noceti Farms <br /> Quarry Excavation Application No. QX-01-1 was approved by the San Joaquin County Planning <br /> Commission on January 3,2002. The effective date of approval is January 13, 2002. This approval <br /> will expire on July 15, 2003, which is 18 months from the effective date of approval, unless (1) all <br /> Conditions of Approval have been complied with, (2) all necessary building permits have been <br /> r secured and remain in force,and (3) all necessary permits from other agencies have been'secured <br /> and remain in force. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact:Jennifer Jolley,468-3161) <br /> { a. PROJECT PHASING: The excavation of the property shall donsistof two phases. The first phase <br /> shall consist of 40 acres more or less, and the second phase shall consist of 21 acres more or less. <br /> Both phases shall be finished within one-year of the effective date of approval. <br /> b. FINAL GRADE:The final grade shall have an average finished grade elevation of no more than 13.1 <br /> feet. <br /> c. STOCKPILING: No stockpiled soil or material shall be placed closer than twenty-five(25) feet to a <br /> property boundary.(DevelopmentTitle Section 9-1415.3[b]) <br /> d. HOURS OF OPERATION: Excavation operations shall not be carried on during the hours from 5:00 <br /> p.m. to 7:00 a.m. except during periods of national, state, or local emergency. Said hours shall be <br /> based on either Pacific Standard Time or Pacific Daylight Saving Time,whichever is legally in effect <br /> e. REMOVAL OF TOPSOIL:The topsoil may be removed from the site. (Development Title Section 9- <br /> 1415.3[g]) <br /> f. WEED CONTROL: If noxious weeds are on the site, operations shall be in accordance with <br /> instructions from the Agricultural Commissioner of San Joaquin County. (Development Title Section <br /> 9-1415.3[h]) <br /> g. HEALTH CONSIDERATIONS:This quarry,excavation shall: <br /> (1) Not cause health or sanitary hazards and not create conditionswhich will cause the breeding or <br /> increase of mosquitos,rodents,or other pests_ <br /> h. SETBACKS: No excavation shall take place within twenty-five(25)feet of any property line or right- <br /> of-way. <br /> ight- <br /> of way. <br /> i.
