F r CONDITIONS OF APPROVAL QX-01-1 Noceti Farms Quarry Excavation Application No. QX-01-1 was approved by the San Joaquin County Planning Commission on January 3,2002. The effective date of approval is January 13, 2002. This approval will expire on July 15, 2003, which is 18 months from the effective date of approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary building permits have been r secured and remain in force,and (3) all necessary permits from other agencies have been'secured and remain in force. Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled prior to the establishment of the use and the issuance of any building permits. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified, and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact:Jennifer Jolley,468-3161) { a. PROJECT PHASING: The excavation of the property shall donsistof two phases. The first phase shall consist of 40 acres more or less, and the second phase shall consist of 21 acres more or less. Both phases shall be finished within one-year of the effective date of approval. b. FINAL GRADE:The final grade shall have an average finished grade elevation of no more than 13.1 feet. c. STOCKPILING: No stockpiled soil or material shall be placed closer than twenty-five(25) feet to a property boundary.(DevelopmentTitle Section 9-1415.3[b]) d. HOURS OF OPERATION: Excavation operations shall not be carried on during the hours from 5:00 p.m. to 7:00 a.m. except during periods of national, state, or local emergency. Said hours shall be based on either Pacific Standard Time or Pacific Daylight Saving Time,whichever is legally in effect e. REMOVAL OF TOPSOIL:The topsoil may be removed from the site. WEED CONTROL: If noxious weeds are on the site, operations shall be in accordance with instructions from the Agricultural Commissioner of San Joaquin County. HEALTH CONSIDERATIONS:This quarry,excavation shall: (1) Not cause health or sanitary hazards and not create conditionswhich will cause the breeding or increase of mosquitos,rodents,or other pests_ h. SETBACKS: No excavation shall take place within twenty-five(25)feet of any property line or right- of-way. ight- of way. i.
