CERTIFICATION OF COMPLIANCE: At the completion of each phase of the grading,the applicant <br /> shall have a registered civil engineeror licensed land surveyor compare the excavation's final <br /> elevations with the approved permit. The engineer or surveyor shall submit a certified,written finding <br /> to the Directorwhich states and documents the compliance or non-compliance of each phase of the <br /> excavation with the approved permit. if Phase 1 of the project conforms with the approved permit, <br /> the Review Authority shall accept the certification and either notify the applicant that the stockpiled <br /> material may be removed or release the required performance guarantee,as specified in subsection <br /> j.(2). If Phase 2 of the project conforms with the approved permit,the Review Authority shall accept <br /> the certification and either notify the applicant that the stockpiled material may be removed or release <br /> the required performance guarantee,as specified in subsection k.(2). <br /> k. PERFORMANCE GUARANTEE: To ensure that each phase of the excavation is completed in <br /> conformance with the approved permit,the operatorshall either: <br /> (1) Stockpile, on the property, all material to be removed from the site for each phase, pending <br /> acceptance of the certification of compliance by the Director. Stockpiled-material shall be set <br /> back at least 25 feet from any property or road right-of-way line;or <br /> (2) Secure a performance bond or other financial security sufficient to cover the cost of rehabilitation <br /> of the site for agricultural use. The form of the bond or other financial security shall be found <br /> acceptable by County Counsel. The amount of the security shall be found acceptable by County <br /> Counsel. All private roads involved in an excavation shall be maintained so as to control dust. <br /> c. Loads on all public roads shall be required to be legal loads.only. (Development Title <br /> Sections 9-1145.4 and 9-1145.5) <br /> e. A Maintenance Agreement shall be executed by the applicant to ensure that Bowman, Manthey, <br /> and all other roads designated by the haul route plan are maintained in a condition acceptable to <br /> San Joaquin County.
