U <br /> Topsoil Removal <br /> The applicant is proposing to remove the topsoil and distribute it off the site. According to Development Title <br /> Section 9-1415.3[g], in agricultural areas,the topsoil shall be set aside, and upon completion of an <br /> excavation,the topsoil shall be replaced and the site leveled in conformance with the excavation permit. <br /> This requirement may be waived if the property is to be rehabilitated for a use, other than agriculture,which <br /> is consistent with the General Plan, or if a soils report indicates the replacement of the topsoil will not <br /> enhance the agricultural suitability of the property. The applicants obtained the services of A&L Western <br /> Agricultural Laboratories to conduct soil studies and provide a soil analysis report. A&L identified the steps <br /> to be taken in order to maximize the remaining soil's fertility, if the Quarry Excavation permit is approved, <br /> resulting in approximately three(3)feet of topsoil being removed. See Attachment A for the soil analysis <br /> report. <br /> Reclamation Plan <br /> The reclamation portion of the project will be to provide a pasture for horses in the area that was excavated. <br /> The purpose of the Quarry Excavation application is to reshape the existing project site so that the land can <br /> be irrigated using the existing wells at the locations shown on the quarry excavation plan. The land will be <br /> put into pasture as the site is graded to the design elevations.The sources of water for the project are the <br /> existing wells located on the project site. The applicant has indicated`that a water truck will be provided to <br /> control dust from the project during grading. <br /> Native American Heritage Commission <br /> On August 15, 2001, the Native American Heritage Commission(NAHC) responded to the Community <br /> Development Departmentwith a memo requesting that the applicant pursue the following actions! <br /> • Contact the appropriate Information Center for a records search; <br /> • Prepare a professional report detailing the findings and recommendations of the records search and <br /> field survey;and <br /> • Contact the NAHC for(1)a Sacred Lands File Check and (2)to obtain a list of appropriate Native <br /> American Contacts for consultation concerning the project site and assist in the mitigation measures. <br /> The Central California Information Center(Department of Anthropology-California State University, <br /> Stanislaus)indicates that no archaeological resources have been reported in the area and that although one <br /> prehistoric occupation and burial site has been recorded, it is far away enough that it is not likely to be <br /> impacted by this project. The Central California Information Center does recommend, however,that a <br /> survey of all open(unpaved)areas be performed by a qualified professional archaeologist. The NAHC <br /> completed a record search of the sacred lands file which failed to indicate the presence of Native American <br /> cultural resources in the immediate project area. The NAHC recommended that Kathy Perez(a Native <br /> American Contact for San Joaquin County)be contacted regarding any further knowledge of cultural <br /> resources in the project area. Ms. Perez informed the Community Development Department that she did <br /> not anticipate the project being detrimental to any cultural resources in the project area. However, if Native <br /> American remains are found during excavation,the County Coroner and the Native American Heritage <br /> Commission,Sacramento,are to be notified immediately for recommended procedures. <br /> Neighbor Concerns <br /> On August 29, 2001,the Community Development Department received a letter of concern from a neighbor <br /> adjacent to the project site regarding the following questions: <br /> San Joaquin County QX-01-11Noceti Farms <br /> Community Development Page 4 <br />
