The developer is Livermore Acres, Inc., i19-A Maple Avenue, <br /> Manteca, California 95336 (the "Developer"). Subject to the conditions described below and to <br /> the applicable District ordinances, resolutions, rules and regulations, the District makes the <br /> following will-serve statements: <br /> Phase 1 Statement: With.appropriate system improvements discussed below in paragraph <br /> A, the District will have available water and sewer capacity and facilities to serve the first phase <br /> of 73 single-family residential units approved by Sar?Joaquin.County for the Subdivision <br /> Property ("Phase I") identified on (snap or plans provided by Lockeford Oaksl attached as <br /> exhibit 1; and <br /> Additional Phases Statement: With appropriate system improvements and expansions <br /> discussed below in paragraph.B,the District will have available water and sewer capacity and. <br /> facilities to serve single family residential units approved by San Joaquin County for the <br /> Subdivision Property in addition to Phase 1, provided that the number of approved units does not <br /> exceed 307. <br /> A. The Phase 1 Statement above is effective only if the Developer completes the <br /> following a-ctions before any certificate of occupancy is issued for any unit contained in. Pbase 1: <br /> 1. The Developer shall develop and convey to the Disfsict a groundwater- <br /> well on the southwest corner of the Subdivision Property near the intersection of Brandt Road <br /> and Jack Tone Road, or at another site to which the District and the Developer mutually agree <br /> (the "Groundwater Weil"). The Developer first skull drill a test well at the well site before <br /> developing a groundwater well. Water-quality testing shall be provided at the Developer's <br /> expense to ensure that the supply meets all applicable State and Federal drinking water <br /> standards. If the Groundwater Well's water quality does not meet those standards or ffie District, <br /> in the exercise of its reasonable discretion, disapproves of the water supplied by the test well, <br /> _l_ <br />
