then the Developer shall install and convey to the District necessary treatment equipment, or <br /> shall find an alternate source. Such an alternate source could include without limitation another <br /> groundwater well, rehabilitation of existing wells, contribution of funding toward fixture <br /> construction of water system improvements, or some combination thereof. Any alternate source <br /> shall be subject to State and Federal drinking water standards and the District's approval, which ' <br /> shall not be,unreasonably denied. <br /> 2. At the site of the Groundwater Well, the Developer shall constructand <br /> convey to the District a hydro-pneumatic tank with a capacity of at least 10,000 gallons, an on- � <br /> site back-up power source equal or equivalent to a diesel generator with fiiel tank and automatic <br /> switching gear, and appropriate connections, site work, enclosures and other facilities <br /> apptiu-tenant to this equipment. <br /> 3. If physically and economically feasible, the Groundwater Well shall be <br /> designed and constructed to provide a flow of at least 900 gallons per minute at distribution <br /> system pressures. If the Groundwater Well cannot feasibly be designed and constructed to <br /> provide that flow, then the Developer shall find an alternate source to be used in conjunction. <br /> with, or instead of, the Groundwater Well to provide the necessary additional flow, sul:je,ct to the <br /> water-quality requirements described above in paragraph A.1 of this letter. Such an alternate <br /> source could 'include without limitation a second groundwater well, rehabilitation of existing <br /> wells, contribution of funding toward future construction of water system improvcinents,, or <br /> some combination thereof. <br /> .. The Developer shall. desrgn and construct and convey to the Dnstxrct a 12- <br /> inch water pipeline extending from the Groundwater Well as follows: (a) to a stub at the <br /> intersection of rack Tone Road and Brandt Road; (b) west along Brandt Road and then north <br /> along Jack Tone Road to a pressure-control valve with vault and manual isolation valves at the <br /> point of connection with the District's existing water system at the intersection of Tack Tone <br /> Road and Dawson Road; and (c) north through the Subdivision Property to the northern <br /> boundary of the property, and then east to a stub on the castern boundary terminating on the <br /> adjacent District property. The Developer also shall design and construct and convey to the <br /> District secondary distribution ruins and metered services in the Subdivision Property. <br /> S. The District may require the Developer to oversize the design and <br /> construction of any of the above-described water facilities in order to accommodate future <br /> development (other than the Subdivision Property) in the District. The District shall rei.inbu.rse <br /> the Developer for the actual incremental cost for any such oversizing, the terms of which <br /> reimbursement shall be set forth in the "Main Line Extension Agreement" described below in. <br /> paragraph A.9 of this letter. <br /> 6. The Developer shall request and obtain from the District c011frni-18.tion <br /> regarding the amount of capacity in the District's wastewater treatment plant and disposal system <br /> (the total capacity of which currently is 0.31 million gallons per day) that remains avail able after <br /> discounting any will-serve statements that are then outstanding.
