The Developer's funding shall be made through mechanisms to be determined by the District, including without limitation the Developer's prepayment of wastewater connection fees that are applicable to treatment and disposal. If the Developer intends to dedicate.real property to the District as the site far additional facilities for the District, the Developer shall identify that real property to the District within 120 days of the date of this letter. If the District accepts the Developer's proposal to dedicate that real property to the District, the Developer shall obtain all approvals or permits and complete, or otherwise fund, all work necessary for the Developer to dedicate completed facilities on that property within 3 years.of the date of this statement or before a certificate of occupancy is issued for any unit not included in Phase I, whichever occurs first. The District reserves the right to modify the terms and conditions stated in this letter if reasonably necessary to address intervening changes in any statute, regulation or other law that applies to the water or wastewater facilities described in this letter, or in any District- wide design requirement, standard or policy that applies to those facilities.
