number of units in Phase I that can be served by the remaining capacity in the wastewater <br /> treatment plant and disposal system, which number shall not be greater than 73 units, The i <br /> District acknowledges that the Developer has purchased 73 will-serve units previously owiled by <br /> Sierra.Nevada Land Co. <br /> 7, The Developer shall design and construct and convey to the District a <br /> tivastewater collection system that is sized far full build-out of the Subdivision Property and that <br /> includes without limitation the following: (a) a force main-pi�eline from the District's <br /> wastewater treatment plant to and throughout the Subdivision Property, and the pipelines, <br /> connections and other'appurtenant.wastewater collection facilities shown as "Option B" (Figure <br /> 5-2) in the Lockeford Community Services District Wastewater System Master Plan, datz d � <br /> September 1998; (b) a wet-well type pumping station located in the vicinity of the southeast <br /> comer of the Subdivision Property near Bear Creek; (c) an on-site back-up power source for the � <br /> pumping station equal.or equivalent to a diesel generator witb fuel tank, automatic switching � <br /> gear and an appropriate enclosure; and (d) access points no greater than 450 feet apart on all <br /> gravity lines and force mains. f <br /> 8. The District may require the Developer to oversize the design and <br /> construction of any of the above-described wastewater facilities in order to accommodate future <br /> development(other than the Subdivision Property) in the District. The District shall reiniburse <br /> the Developer for the actual incremental cost for any such oversizing, the terms of which <br /> reirnbursement shall be set forth in the Main Line Extension Agreement. <br /> I <br /> 0 <br /> Before design or construction begins on any of the water or wastewater i <br /> facilities described above in this paragraph A, the District and the Developer shall enter into a <br /> main line extei'isio.n.agreemerit for the Subdivision Property in accordance with the applicable � <br /> District ordinances,resolutions, rules and regulations and in a form acceptable to the District (the j <br /> "Main Line Extension Agreement"). The District's current form of a main line extension � <br /> agreement is attached as exhibit 2. j <br /> B. The Additional Phases Statement above is effective only if the Developer <br /> f <br /> completes, before any certificate of occupancy is issued for any unit not contained in Phase 1, <br /> those actions described in paragraph A above and the following actions-. <br /> 1. The. Developer shall request the.District to determine what amo-Lust, if any, j <br /> of additional capacity is necessary in the District's wastewater treatment plant and disposal <br /> systern to serve the number of units proposed for the particular phase of development on the <br /> Subdivision Property. The District shall determine the amount of necessary additional capacity, <br /> and shall dete=ine the improvements that must be made to the District's wastewater treatnnent <br /> plant and disposal system to achieve the increased capacity, including without liniitati.on any <br /> acquisition and development of new treatment, storage and disposal areas. <br /> ?. The Developer shall fund the design and construction of improvements <br /> that the District determines are.necessary to serve the particular phase of development on the <br /> Subdivision Property proposed by the Developer, including without limitation any acgLrisition <br /> -3- <br />
