The District may require the Developer to oversize the deaign and construction <br /> of any of the above-described wastewater facilities in order to accommodate future development <br /> (other than the Subdivision Property) in the District. The District shall reimburse the Developer for <br /> the actual incremental cost for any such oversizing, the terms of which reimbursement shall be set <br /> forth in the Main Line xtension Agreement. <br /> Phase 9. Before any certificate of occupancy is issued for any unit contained in h�► 1, a <br /> the District and the Developer shall enter into a main line extension agreement for Phase 1 in <br /> accordance with the applicable District ordinances, resolutions, rules acid regulations and in a form <br /> acceptable to the District(the AMain Sine Extension Agreement @). <br /> The District reserves the modify to right the terms and conditions stated in this letter if <br /> l3 � <br /> reasonably necessary to address intervening changes in any statute, regulation or other law that <br /> applies to the water or wastewater facilities described in this letter, or in any District-wide design <br /> requirement, standard or policy that applies to those facilities.
