The District may require the Developer to oversize the deaign and construction of any of the above-described wastewater facilities in order to accommodate future development (other than the Subdivision Property) in the District. The District shall reimburse the Developer for the actual incremental cost for any such oversizing, the terms of which reimbursement shall be set forth in the Main Line xtension Agreement. Phase 9. Before any certificate of occupancy is issued for any unit contained in h�► 1, a the District and the Developer shall enter into a main line extension agreement for Phase 1 in accordance with the applicable District ordinances, resolutions, rules acid regulations and in a form acceptable to the District(the AMain Sine Extension Agreement @). The District reserves the modify to right the terms and conditions stated in this letter if l3 � reasonably necessary to address intervening changes in any statute, regulation or other law that applies to the water or wastewater facilities described in this letter, or in any District-wide design requirement, standard or policy that applies to those facilities.
