At the site of the Groundwater Well,the Developer shall construct and convey <br /> to the District a hydro-pneumatic tank with a capacity of at least 10,000 gallons, an on-site back-up <br /> power source equal or equivalent to a diesel generator with fuel tank and automatic switching gear, <br /> and appropriate connections, site work,enclosures and other.facilities appurtenant to this equipment. <br /> 3. if physically and economically feasible,the Groundwater'Well shall be designed <br /> and constructed to provide a flow of at least 900 gallons per minute at distribution system pressures, <br /> If the Groundwater Well cannot feasibly be designed and constructed to provide that flow, then the <br /> Developer shall find an alternate source to be used in conjunction with, or instead of, the <br /> Groundwater Well to provide the necessary additional flow, subject to the water-quality requirements <br /> described above in paragraph 1 of this letter. Such an alternate source could include without <br /> limitation a second groundwater well, rehabilitation of existing wells, contribution of funding toward <br /> future construction of water system improvements, or some combination thereof. <br /> 4. The Developer shall design and construct and convey to the District a 12-inch <br /> water pipeline extending from the Groundwater Well as follows: (a)to a stub at the intersection of <br /> Jack Tone Road and Brandt Road,(b)west along Brandt Road and then north along J ack Tone Road <br /> to a pressure-control valve with vault and manual isolation valves at the point of commotion with the <br /> District=s existing water system at the intersection of Jack Tone Road and Lockeford Ranch Road, <br /> and (c) north through the Subdivision Property to the northern boundary of the property, and then <br /> east to a stub on the eastern boundary terminating on the adjacent District property. The Developer <br /> also shall design and construct and convey to the District secondary distribution mains and teetered <br /> services in the Subdivision Property, <br /> 5• '.Che District may require the Developer to oversizersize the design and construction <br /> of any of the above-described water facilities in order to accomodate future development (other <br /> than the Subdivision Property) in the District. The District shall reimburse the Developer for the <br /> actual incremental cost for any such oversizing,the terms of which reimbursement shall be set forth in <br /> the .Main Line Extension Agreement@ described below in paragraph 9 of this letter. <br /> d, The Developer shall request and obtain from the District confirmation <br /> regarding the amount of capacity in the District=s wastewater treatment plant and disposal system <br /> (the total capacity of which currently is 0.31 million gallons per day) that remains available after <br /> discounting any will serve statements that are then outstanding. The Di strict shall confirm the number <br /> of units in Phase T that can be served by the remaining capacity in the wastewater treatment plant and <br /> disposal system,which number shall not be greater than 73 units. The District acknowledges that the <br /> Developer has purchased 73 will serve units previously owned by Sierra Nevada Land Co. <br /> 7. The Developer shall design and construct and convey to the District a <br /> wastewater collection system that is sized for full build-out of the Subdivision Property and that <br /> includes without limitation the following: (a) a force main pipeline from the Districts wastewater <br /> _2_ <br />
