r <br /> , <br /> u <br /> CONDITIONS OF APPROVAL FOR SU-91-15 <br /> Unless otherwise specified, all Conditions of Approval shall be complied with prior to the approval of the Final Map. <br /> This approval will expire three years from the date of approval unless (1) all Conditions of Approval have been <br /> complied with and (2) a Final Map has been filed with and accepted by the Surveyor's Division. <br /> Those Conditions followed by a Section Number of other Statutory Requirement are based on Ordinance <br /> requirements. Ordinance requirements cannot be modified. <br /> 1. DEVELOPMENT SERVICES DIVISION: <br /> a. The approval of Major Subdivision Application No. SU-91-15 shall be contingent upon approval by the <br /> Board of Supervisors of Zone Reclassification Application No. ZR-92-13. The effective date of the Major <br /> Subdivision application shall be 30 days after approval of the Zone Reclassification application. <br /> b. The minimum lot size for Lots 1 through 210 shall be 8,000 square feet. (Section 9-5253 of the Planning <br /> Title) <br /> C. The minimum lot width for Lots 1 through 210 shall be 65 feet. (Section 9-5254 of the Planning Title) <br /> d. The minimum dimensions for comer lots located within Lots 1 through 210 shall be 65 feet by 65 feet. <br /> (Section 9-3226.5 of the Planning Title) <br /> e. The following measures shall 4e taken to preserve the site's native oak trees: <br />€ (1) At least 80 percent of the native oak trees on the northern portion of the site shall be preserved <br /> and maintained. <br /> (2) Each native oak tree that is removed during construction shall be replaced by three native oak <br /> saplings planted at a site accepted by the Community Development Department. The species <br /> l <br /> of oak sapling to be planted shall be suitable for the climate and soil type at the replacement site. <br />[ (3) Each heritage oak tree that is removed during construction shall be replaced by five native oak <br /> saplings planted at a site accepted by the Community Development Department. The species <br /> of oak sapling to be planted shall be suitable for the climate and soil type at the replacement site. <br /> Each historical tree that is removed during construction shall be replaced by five saplings of the <br /> same species and variety as the historical tree. (Development Title Section 9-1505.4(d)(1)) <br /> (4) The oaks shall be managed under the direction of a qualified arborist or biologist according to <br /> 'Living Among the Oaks: A Management Guide for Landowners` (UCCE, 1988). <br /> (5) Prior to the start of construction, all trees selected for conservation shall be identified and <br /> protected by barriers placed at least six feet outside of the tree's dripline. Barriers shall be five <br /> feet high and shall remain in place throughout the project's construction phase. <br /> (6) A homeowners' association shall be established to manage and maintain the common open <br /> spaces, including maintenance of existing and newly planted replacement native oaks. <br /> Maintenance shall consist of species selection, planting, and short-term (three years) cultivation <br /> and shall be carried out by a qualified arborist or biologist. Information regarding these <br /> homeowners' association responsibilities shall be placed in the Covenants, Conditions, and <br /> Restrictions (CC&Rs). <br /> -1- <br />
