" In order to maintain an acceptable LOS under cumulative conditions, the developer will be required at the tentative map stage to contribute the necessary pro rata share of the cost associated with the necessary road improvements identified by the Final EIR. I 10. The conclusion of the EIR was that there would be no significant, unavoidable adverse impacts related to cultural resources. However, in the event that such resources or human remains are discovered on the site, specific actions are required to protect them. 13. a. The project was not found by the EIR to be a growth- inducing action. 14 . Air quality impacts associated with the project were the only cumulative impacts identified by the EIR. In approving the earlier General Plan Map Amendment and Zone Reclassification applications, the Board of Supervisors adopted both "Findings of Significant Environmental Impact" and "Statements of Overriding Considerations. " Approval of this application would require that the same actions be taken by the Planning Commission. 16.a. The EIR indicated that the project would have an adverse impact upon the habitat of the Swainson' s hawk and would result in adverse cumulative air quality impacts. The former will be mitigated at the tentative map stage by either the acquisition and improvement of off-site foraging habitat or by entering into an agreement to join the City of Stockton's Swainson's Hawk Habitat Conservation Program.
